What are the causes of conflicts between heirs?

The Law of Inheritance allows the heirs to enter into an agreement for the division of the estate and even to deviate from the division instructions stipulated in the will or the laws of inheritance.

"This agreement," says attorney Roi Levy Avshalom, from the office of attorney Rafael Levy Avshalom, which specializes in wills and inheritance, "can allow the heirs to divide the estate in the most suitable way for them, even if it does not follow the legal inheritance provisions."



According to him, "sometimes there are assets that cannot be realized or distributed among the heirs in a certain way, sometimes this is due to tax considerations, and this is where the agreement comes in that allows this to be done in a logical way and without infringing the rights of anyone involved."

We often hear about conflicts between heirs, especially when it comes to an estate rich in assets.

Will a will prevent the fights?



"Drafting a will is important, it may resolve some of the disputes, but not always. The courts are loaded with cases of heirs who demand to cancel or oppose the will due to many reasons such as unequal distribution between the heirs, claims of 'taking over the will', 'unfair influence on the will' ', interpretation of a will, allowed to children from previous marriages and more."



What can be done to avoid heir conflicts?



"It is not always possible to prevent these conflicts, but there are certainly things that can be done to reduce the disputes and to bridge the gaps. It is important to seek legal advice as early as possible, even before drawing up the will and of course after the death of the deceased. Legal advice will help in understanding the extent of the deceased's estate , the number of heirs and the execution of the will or inheritance".
