He was delivering to go to Spain and was run over by a drunk and drugged driver: "Rappi's backpack saved me"

2023-05-02T10:15:20.465Z

Andrés Diante (26) was riding a motorcycle through the Libertador tunnel when a car hit him head-on in the wrong direction. He has been hospitalized for ten days.

"I don't know whether to laugh or cry. Here I am,

hanger

but alive. After what happened to me, I saw the photos of how my motorcycle turned out, of the hood of the car... I think I have to celebrate, right?" .

On the third floor of the Fernández Hospital, in trauma hospitalizations, Andrés Diante (26) talks looking at the light that filters through a crack in the closed window of his room, which he shares with an elderly man who is sedated.

"I am well cared for, but

the days don't pass me by anymore and I have pains all over my body. The uncertainty kills me

.

I want to know what the doctors say, if they have to operate on me again or not."

On Friday, April 21, at 4:30 in the morning, Andrés, who makes deliveries for the

Rappi

delivery app

, was driving his Gilera motorcycle from Belgrano to Palermo.

"I came to leave an order and the application sent me to Honduras street. I was calm, prudent as always... there was no one at that time.

I chose to work at night to avoid the traffic chaos of this city

. But I never imagined that this was going to happen to me, not even in my worst nightmare," he describes to

Clarín

between complaints and pain.

Andrés takes a deep breath, asking for the upper part of the horizontal bed to be raised.

He sits up and

drinks a glass of plum yogurt

.

"Among everything that happens to me, which is not little, I haven't been in the body for ten days, so I hope that with this I can alleviate myself, I can't take the feeling anymore," he confesses intimately.

Francisco Oberti (39), in an express trial, was sentenced to 3 years in suspended prison and 4 years of disqualification from driving for having done so under the influence of alcohol (he gave a positive drug test).

"Already inside the tunnel -he resumes-, near the curve, I could not understand what I was seeing...

A car at all that it gives that came directly to me

. There were five seconds that preceded an unavoidable death. I thought of thousands of things at that moment, but I saw myself dead. I managed to accelerate, because I thought that if I braked I would end up under the wheels. I had no escape, no time to drive and at the same time I thought that it couldn't be that I was about to die".

He clutches his head, scratches his beard, but does not lose his lucid, slow tone of voice.

"I accelerated and instantly felt the very strong impact from the front, trunk against trunk, a hickey in the mouth -illustrates seriously, with his eyes fixed on that ray of light-. Between the motorcycle and my fall there was about twenty meters of distance. I I flew and when I saw myself in the air I closed my eyes, I remember perfectly and I saw a light... I thought 'I'm dying'... until I fell heavily on the pavement".

"I'm bitter about everything that happened, but I think how much worse I could find myself... I have a theory that

Rappi's helmet and backpack

, which I was wearing, saved me. It's big, half-padded and for me it

cushioned the fall

blow, as if it were an airbag

, "he confesses.

Andrés Diante (26) has his left arm and right foot in a cast.

They nailed him and the doctors could operate on him again.

Lying on the ground, without losing consciousness, Andrés stared at the car.

He was screaming in pain, asking for help, but there was no one around him.

"I didn't see the motorcycle, but I did see the Gol Trend of this guy who screwed up my life... Suddenly the car door opens, I see him coming towards me, walking slowly, he looked like a zombie, totally gone, he didn't

say

anything and I yelled at him

'what did you do skinny, what did you do!'

.

"He didn't answer me, he kept walking and the first thing I thought was that he was going to kill me. I was in

shock

, I asked for help and I had terrible pain in the genital area."

Andrés, who incredibly has no marks on his face, recounts as if he were a witness to his own accident.

This is how Andrés Diante's Gilera motorcycle was left, after the head-on collision with the Gol Trend that Francisco Oberti was driving.

Andrés remembers his face well and found out his name and believes that he is from a wealthy family.

"The guy who ruined me is called

Francisco Oberti (39)

. I told him

'why did you do this to me, skinny? How can you go 200 meters the other way down Avenida Libertador and into the tunnel?

The kid was recovered, he told me He looked, he didn't say anything... like he didn't understand

.

'You screwed up my job, you left me without a motorcycle, without a life project'

".

Everything is very fresh about this young man born in the San Martín district, who today lives in Barrio Norte with his wife Valentina.

"I am here by chance, in this world... And that gives me chills."

The image of a policeman appears to him, whom he wants to thank.

"He appeared just and got rid of the guy who ran over me ... he told me:

'Flaco, stay calm, there is no blood to be seen. An ambulance is coming'

, he tried to calm me down because I was no longer in pain."

"I want to go back to being who I was, and I think it will be something that will cost me a lot," says Andrés Diante, here in a recent image.

He admits that it was not an easy task for the police officer to try to calm him down.

"I was in

shock

, I writhed in pain in my lower area and I thought I was bleeding and you couldn't see it... I repeated

'I don't want to die, I don't want to die'

. Being aware of everything that was the shock, the little while before and lying there made me even more desperate... Then another elderly man appeared, very kind, and someone contacted my wife, who, poor thing, came directly to the Fernández Hospital".

Think more about everything that could have caused the crash and fall.

"From having become a quadriplegic, to being unconscious or with cerebral sequelae. It's hard for me to sleep, many images come to mind. When you have a motorcycle, you know something could happen to it, but it never occurs to you to imagine that you're going to give a

stick

head-on with a drunken and

blundering

madman who drives in a tunnel the wrong way".

With his right hand, he carefully accommodates his left arm in a cast.

He asks for help rolling onto his side and sighs with the effort.

"They put

nails in my hand and foot

. I thought they were two definitive operations, but it seems to me that

they will have to operate again

. I don't know if these days or when the bones are welded. I'm waiting this week to be able to talk with the doctors."

Andrés lived in Pehuajó for a while until the end of 2022, where he worked in his in-laws' store.

In January

he came to Buenos Aires with his brand new motorcycle to look for work

and where to live for him, once installed, tell his girlfriend Valentina to join "the project."

He says that "the idea was to come to Buenos Aires, work hard, save as much as we can and in 2024

go to Spain

. I was doing well, earning

more than 300,000 pesos with

Rappi

working from nine at night to nine in the tomorrow and my wife already had a position in a restaurant... And now? What the hell do I do?", he chews angrily.

"Nothing ever happened to me, never a hospitalization, a surgery... Until I had to go through all this because of a lunatic."

Uncertainty disturbs him, not to mention the loss of earnings.

"I took ten Lucas to my house every day.

I haven't generated a mango for ten days

. Who gives me a hand? I have no idea what I'm going to do... The only thing that I am clear about is that I want to get well , I want economic compensation and I think

I will never get on a motorcycle again",

estimates Andrés, who says he has a lawyer.

"The only thing I told my lawyer is that I want justice."

The shattered bonnet of Francisco Oberti's Gol Trend, after hitting Rappi's delivery.

He confesses that every night he prays to give thanks and to recover as soon as possible.

"Fears come to me because new pains appear in my chest, at the level of my heart, in my belly, in my back. And you think a lot of things... And how life changes you in a second, and your fears

disappear they get prepo...

like not wanting to get on a motorcycle again".

He winces.

"Please, can you call the nurse."

abbreviated trial

Francisco Oberti, the driver who entered the wrong way with his car in the Avenida del Libertador tunnel and ran over the motorcyclist Andrés Diante, was sentenced to

three years in prison suspended

and four years effectively disqualified from driving vehicles.

Oberti was investigated and sentenced by the Criminal, Misdemeanor and Misdemeanor Court No. 13 of the City, in charge of Judge María Lorena Tula del Moral.

It was an abbreviated (or express) trial, 24 hours after the incident occurred.

“The City's accusatory system is faster than the National one.

It is not the first sentence handed down in a few hours, it occurs in many cases of drug dealing, and this is because

the evidence obtained by the prosecutor is irrefutable

and since the case is well presented, the judge has a clear picture to discern the facts and judge",

Clarín

had published

on Saturday, April 22.

Oberti, who did not have a criminal record, who lives very close to the tunnel, in Luis María Campos at 1300,

had 1.06 grams of alcohol per liter of blood

-more than double the limit of 0.5 in force in the City of Buenos Aires- and

gave a positive drug test for the presence of methamphetamine.
