Beyond having enough money to buy a property, it is important to know that this operation involves the payment of a series of financial and legal obligations. Beyond the price of the property, a series of expenses must also be taken into account in the process, including the deed.

To avoid surprises and unforeseen events, you have to be prepared about what the steps are and how much extra money you have to have, in addition to the documents that are necessary to present in the operation.

What is the deed of a property?

It is a title that is bought or sold in the transaction of a property. There are properties that may have some embargo, inhibition or that, simply, have several owners and some of them have a problem that makes it impossible to sell their part.

That is why the figure of the notary is key throughout the process of buying a property, since they are the ones who are responsible for checking and confirming that all the documentation and papers are in order, comply with the legal provisions and that the property is suitable for sale.

Therefore, the signature of the ticket of sale of a property must be done on stamped paper before a notary public next to the signature of the certificates, otherwise it is not valid. The protection of the property is just when buying the title of the property.

How much does it cost to deed a property?

With regard to the value of the fees and some remunerations, each one is tariffed in an aliquot that is made up of a variable depending on the value involved and a fixed minimum, which is updated through the Board of Directors of the College of Notaries.

The seller must take care of all the expenses that are generated prior to the deed (study of titles, certificates, free debts) and the buyer of the post writing: registration in the property registry and notary fees, because it is the one who has the right to choose it.

Costs of a deed in CABA:

"In general, based on a deed of sale of a property in Caba, the percentage for the seller is 3.7% plus the sum of costs of certificates, some remuneration and fixed components of items that make the seller's invoice," said the president of the Tariff Commission of the College of Notaries of Caba, María Celeste Gerarduzzi to Clarín.

The selling party must pay the following percentages based on the deed price:

tag. Property Transfer Tax: 1.5%

tag. Stamp Tax: 1.8%

tag. Study of titles: 0.2% (A fixed minimum amount is also added)

tag. Certified legal processing and evaluation: 0.2% (A fixed minimum amount is also added)

On the other hand, Gerarduzzi explained that "the percentage for the buyer reaches 4%, plus the sum of some remunerations, expenses of pages and rights, contributions and some remunerations that make the buyer's invoice".

The buyer must pay the following percentages based on the deed price:

tag. Registration Fee: 0.2%

tag. Fees: 2%

tag. Stamp tax: 1.8%. In some cases the buyer's invoice could include the rate corresponding to the notarial contribution that is currently 0.25%.

In both cases, seller and buyer, you can charge the Tax Law 25,413 on those tax payments that must be made by check and through a checking account.

Costs of a deed in Province of Buenos Aires:

For the deed of a property located in the province of Buenos Aires, the selling party must pay the following percentages based on the deed price:

tag. Property Transfer Tax (it is the same for the case of acquisition after tax reform 2018): 1.5%.

tag. Stamp Tax: 1%

tag. Study of degrees: 0.2%

tag. Certificates and processing: 0.2%

Total percentage: 2.90%.

For its part, the buyer must pay:

tag. Stamp Tax: 1%

tag. Registration fee: 0.2%

tag. Notarial contribution: 0.25%

tag. Fees: 2%

Total percentage: 3.45%.

What percentage does the notary receive?

The incidence of the notary's fee within the buyer's invoice is approximately half and within that of the seller, approximately 10%.

The tariff regulations remunerate the work of the notary with a rate of 2% applicable on the basis that is greater taking into account: the price of the operation; the present value of the assets; tax valuation or VIR.

"Its calculation is very easy and undoubted because we must not forget that we have a bimonetary economy that has historically made the real estate market express itself in US dollars," said the notary Gerarduzzi.

"In the case of deedable assets that are quoted in dollars and therefore, the notary responds in civil, criminal, tax and disciplinary matters for the market value of the same, it is simple and logical that the remuneration of the notary is a percentage of the aforementioned price or value, "he said.

Meanwhile, he stressed that it should be borne in mind that there are also other expenses, such as the study and registration of degrees, certified processing, reports, withholdings, etc., all of them with a very small incidence.
