Carla Hinrichs is probably the best-known face of the "Last Generation". Shortly after a suspended sentence, the activist is already gluing herself again.

The 26-year-old from Bremen, who has already been a guest on political talk shows such as Anne Will and Maischberger, took part in the traffic blockades of the group, which was given the unflattering nickname climate glue for its actions on the streets. At 17 different locations, the protesters slowed down vehicles this Monday.

In a photo she tweeted, the former law student can be seen sitting next to a young man on the street, while one of the well-known banners with the demand "More democracy – social council now" is displayed in front of her. "I took to the streets again today to protest for the preservation of our livelihoods. Even the sentence of two months in prison on probation can't stop me," she writes, already announcing a repetition: "Tomorrow I will peacefully bring Berlin to a city standstill again."

In a video distributed by the "Last Generation" under the title "After prison again on the streets", Hinrichs emphasized: "We are not doing this here for fun. We're doing this because we're hurtling into one of humanity's greatest catastrophes." Then, as examples, she cites crop failures and future waves of refugees for climatic reasons, to continue: "We sit down here on the street to stand in the way of this everyday life that takes us over the cliff." Finally, she asks directly into the camera: "When are you going to come and stand in the way of this injustice?"

Climate protest in Berlin: Carla Hinrichs threatens to tighten her suspended sentence

It was only on Sunday that she spoke out via her own Twitter account and announced: "I'm going back on the streets tomorrow. No verdict will stop me from protesting for justice." At the same time, she also recruited supporters who would have to undergo protest training beforehand. According to the "Last Generation", this is a prerequisite for participation in a protest.

The verdict to which Hinrichs alluded is only a few days old. Last week, she was sentenced by the district court of Frankfurt am Main to a two-month prison sentence, suspended for three years, for a previous participation in a protest action. It was about a road blockade from April 2022.

In the first instance, Hinrichs had been fined, against which she appealed. However, according to a spokeswoman for the court, the suspended sentence is not yet legally binding, as there are still objection periods. This was learned by the German Press Agency (dpa) when asked. Hinrichs had already indicated that she is likely to appeal. However, if the Frankfurt verdict becomes final and Hinrichs is convicted again for the Berlin action, a violation of probation could be established. Then it could be that Hinrichs will have to start her prison sentence.

Is Carla Hinrichs facing a prison sentence? No deterrent effect of the suspended sentence

In the Criminal Code, §56 Suspension of Sentence emphasizes that courts should resort to probation "if it is to be expected that the convicted person will already use the conviction as a warning and will not commit any more crimes in the future even without the influence of the penal system". It is therefore a question of the deterrent effect of a suspended sentence. Obviously, this did not unfold with Hinrichs.

§56f Revocation of the suspension of sentence states as a reason to revoke a suspended sentence that "the convicted person commits a criminal offence during the probation period and thereby shows that the expectation on which the suspension of sentence was based has not been fulfilled". After her sentencing, Hinrichs had also pointed out in a video message that she was frightened by the judge's reasoning that he would pass the verdict in "complete sobriety" because her motives would not play a role. According to her own statements, she had renounced a lawyer at her side. In one photo, she can be seen alone in the dock.

Prison sentences for members of the "Last Generation": Judges crack down in Heilbronn and Berlin

Hinrichs, who has already been fined 2022 euros for a blockade in February 600, would not be the first member of the "Last Generation" to be sentenced to prison as a result of the protests. For example, a judge at the Heilbronn District Court sentenced three climate activists to three, four and five months behind bars for blocking traffic on a federal highway. A 24-year-old woman was sentenced to four months in prison by the Berlin-Tiergarten district court for sticking herself to the frame of a work by the painter Lucas Cranach and taking part in a road blockade.

In the most recent protests on Monday, the group, which divides the country, said it had worked with a sand-glue mixture that made it difficult for police to remove the stuck hands from the asphalt. The law enforcement officers explained that cut-off grinders were used at the corner of Danziger Straße and Prenzlauer Allee, causing road damage that had to be repaired by the civil engineering office. The solution was more practical at the Hohenzollerndamm driveway, where activists had glued themselves to the tires of rental cars. Here, the emergency services helped themselves with simple tire changes. (mg)
