According to the indictment, during a week of training by the Egoz unit, in a firing zone near the Nabi Musa base, the officer was negligent in that he went out at night, alone and without informing his commanders, to search for a night vision device stolen from the unit. During the patrol, the officer cocked the weapon he was carrying.
At the same time, Maj. Elharar and Maj. Aharon, together with two others, went on a field patrol. The force, unaware that the officer had gone on patrol, identified him as a suspicious figure and followed him. At some point, the officer noticed figures pointing weapons at him from a short distance and fired at them. Only later, shortly after the shooting, did the officer discover that they were his comrades.
The bereaved families welcomed the indictment. Attorney Ran Cohen Rochberger, who represents them, said, "This is the right and necessary decision, both legally and morally. The indictment that was filed reflects Lieutenant N.'s gross negligence that led to the boys' fall in the terrible disaster. The families hope justice will be done in the legal process."
