The judge annuls the expulsion of a mayor of Vox for a complaint of drug use

The former councilor in the Madrid municipality of Galapagar was removed from the formation in a fulminant way


A judge in Madrid has annulled the expulsion of Cristina Gómez Carvajal, former councilor of Vox in Galapagar (Madrid), and Miguel Albolafia, militant of the same party, for violation of their fundamental rights. Gómez and his partner were expelled in a fulminant way on October 13, 2020, after the presentation in the barracks of the Civil Guard of Galapagar of a complaint for "alleged crimes against the physical and psychological integrity of third parties". Vox sources then told the Efe agency that the mayor had been denounced for consuming narcotics in front of her minor children.

The case was dismissed, but Vox did not revoke the expulsion of its councilor in Galapagar or the other militant of the ultra formation in the Madrid town. The drastic measure adopted then contrasts with the attitude that the party now maintains with its councilor of Parla Ana González Martínez, arrested in an anti-drug operation. Both she and her husband have entered prison by order of the judge, accused of the crimes of drug trafficking, money laundering and electricity fraud, as alleged leaders of a cocaine sales network in the south of Madrid. Despite these facts, Vox has not announced the opening of a disciplinary file and its president in Madrid, Rocío Monasterio, has limited herself to declaring: "First, presumption of innocence. And the second thing, if what they say is confirmed, I hope that he delivers the minutes and presents the resignation." Ana González has not delivered the act, but if she has renounced to repeat as number three in the candidacy of Vox for Parla in the municipal elections of 28-M, as announced by the party.

On the other hand, in the case of the councilor of Galapagar, Vox opened a disciplinary file that was solved, in a single day, with her expulsion "without prior transfer of the complaint, without hearing or possibility of allegation and evidence", according to the sentence issued on day 3 by the Court of First Instance Number 47 of Madrid. This way of acting, warns the judge, constitutes "a violation of the fundamental right of association", which includes "the right to scrupulously respect the internal disciplinary procedure". Consequently, it declares null and void the expulsion of the two Vox militants and condemns the ultra party to pay the costs, although it can file an appeal before the Provincial Court of Madrid.

The Vox councilor in Galapagar had become famous for promoting the caceroladas in front of the house of then Vice President Pablo Iglesias and Minister Irene Montero, but she had become an uncomfortable figure for the party after the head of Equality denounced her for harassment and said that the Minister of the Interior, Fernando Grande-Marlaska, "the young men were going to him". It so happens that the complaint against Cristina Gómez was filed by Loic Vellard, alias El Francés, an ex-convict with ties to the Bulgarian mafia and the direction of Vox, according to El Español. He went to the Civil Guard barracks to file the complaint accompanied by José Higaldo Serra, the national head of security of the ultra party.
