A judicial presentation against the candidacy of Jorge Macri was made official and the Buenos Aires internal heats up

The pre-candidate for Head of Government for the city of Buenos Aires for the Popular Change party, Nito Artaza, filed a challenge in the Buenos Aires electoral justice to define if Jorge Macri can be a candidate in the district.

The former senator based his presentation on the fact that the PRO candidate "was not born in the City of Buenos Aires as required by the Buenos Aires Constitution" and also "certified domicile in Vicente López where he is mayor with license."

"My need to clear the uncertainty to which citizens are subjected, lies in the journalistic versions, television interviews (and the statements of former President Mauricio Macri) that would indicate that Mr. Jorge Macri, an official born in another jurisdiction (...) could run in the next primary and general elections to the category Head of Government of this City, in flagrant violation of the current Electoral Law," the presentation states.

Although Artaza recognizes that the "challenge of candidacies is appropriate when they have been formally presented" and that has not yet happened, "the notoriety that the pre-candidacy of Mr. Jorge Macri has gained, and his own statements to the media, force me to request your intervention."

The request of Artaza – who recalls that Macri voted in the province of Buenos Aires in 2019, fixing domicile in that jurisdiction – is based on the fact that the Buenos Aires Constitution provides as a requirement "to be a native of the City or to possess a habitual and permanent residence not less than five years prior to the date of the election".

"The aforementioned necessarily had to vote in 2019 in the Province of Buenos Aires. Well, how could he be an elector or aspire to an elective office in CABA, then four (4) years later, when the CABA Constitution explicitly provides for five (5)?", says the brief presented to the justice.

The radical leader affirms that, if materialized, the candidacy of Jorge Macri "would offend democratic institutions, could hinder the future electoral process with the consequent damage to citizens – as we recently saw in two Argentine provinces – and would threaten transparency and respect for Democracy."
