Woman insulted by a police officer: the prosecutor finally asks for a trial

The officer is accused of calling a sexual assault complainant a "whore" on his answering machine in February 2022.


The Paris prosecutor's office requested in mid-April a trial for a police officer accused of having called a complainant for sexual assault a "whore", after first closing his complaint against the official, we learned Saturday from a source close to the case. In February 2022, the then 34-year-old woman filed a first complaint in a Paris police station for "sexual assault while drunk", leading to the opening of an investigation, revealed by Mediapart.

A police officer had left her a message on his answering machine to complete her complaint. Thinking he had hung up, the official could be heard joking, then adding, "She's really a whore. (...) Fuck, she refuses the confront ' in addition to the whore. As luck would have it. Actually it was just to break his balls, I'm sure. (...) Fuck, big whore," he concluded, before the handset was hung up. The prosecutor's office had closed the proceedings because "the remarks had been made without wanting to bring them to the attention of the complainant".

'Non-public insult because of sex'

Seized of these facts after a new complaint, an investigating judge indicted the police officer on 3 January. In its submissions of April 19, which AFP has seen, the Paris prosecutor's office reiterates its assessment that the police officer spoke "confidentially to his colleagues and without intention of bringing (his remarks) to the attention of the complainant", but considers that since this offence falls under press law, the debate on the merits can only take place before the court.

He therefore requested a trial before the police court for "non-public insult on account of sex". The final decision on a hearing rests with the investigating judge. Asked by AFP, the lawyer of the policeman, who admitted the facts during the investigation, had not reacted Saturday. This case had sparked widespread criticism of the care of victims of sexual violence by the police.

The Minister of the Interior, Gérald Darmanin, had considered that the policeman had "no place" in the profession, while the former prefect of police Didier Lallement had seized the "police police" (IGPN). "The prosecutor's office had dismissed the case without even questioning my client. The judicial path on sexual and gender-based violence does not go through the prosecutor's office," said Arié Alimi. On the sexual assault itself, the lawyer said he had requested that an investigating judge be seized.
