This coming Sunday, the government is expected to discuss a draft resolution by Otzma Yehudit entitled "Zionism as a Guiding Value in Government Actions," which states that the values enshrined in the Nation-State Law will be anchored in government policy.

This is a proposal by Minister of the Negev and Galilee Yitzhak Wasserlauf that was included in Otzma Yehudit's coalition agreements, intended to translate into policy on the ground the Nation-State Law enacted in 2018 that anchors the Jewish character and identity of the state. However, the proposal aroused controversy and criticism at home and internationally because it does not anchor its democratic character or the equal rights of minorities in Israel. Against the background of the political tension surrounding MK Ariel Kellner's proposed NGO Law, the approval of the resolution implementing the Nation-State Law in the government is likely to generate additional international criticism.

The resolution states that the government must "instruct government ministries and all branches of the government that the values of Zionism, as expressed in the Basic Law: Israel as the Nation-State of the Jewish People, will constitute guiding and decisive values in shaping public administration policy, domestic and foreign policy, legislation and actions of the government and all its units and institutions – both at the stage of shaping public policy and at the stage of assimilation and implementation of public policy. First and foremost in the areas of settlement and in the provision of benefits to those who served in the army and security forces or in civilian national service, while preferring those who served in combat service. This, without derogating from the principles enshrined in the Basic Laws." According to Wasserlauf, the initiator of the proposal, it will make it possible to give priority to IDF soldiers and veterans, "to establish the connection of the Jewish people to its land and to strengthen the Negev, Galilee and Judea and Samaria."

The bill's explanatory notes state: "As of today, the policy set by decision makers in the government and its branches takes into account various professional considerations. Sometimes, these considerations ignore the basic values of Zionism. Values that express the right of the Jewish people to self-determination in the Land of Israel, including settlement, security, culture and immigration, as recognized, inter alia, in the Balfour Declaration and the Declaration of Independence and enshrined in the Basic Law: Israel as the Nation-State of the Jewish People.

The legal advisor of the Ministry of the Negev and Galilee notes that the proposal raises legal difficulties because, although it states at the end: "Without derogating from the principles enshrined in the other Basic Laws, it grants the values of Zionism as expressed in the Nation-State Law "a status that overrides other basic values that have the same normative status from a constitutional point of view."
