The forensic of the Institute of Legal Medicine of Seville that has reviewed the state of health of the former Andalusian president José Antonio Griñán points out that he should be treated for his illness outside prison in a report addressed to the Audience of Seville, responsible for executing the conviction of the Supreme Court for the case of the ERE . The doctor believes that the hormonal treatment and radiotherapy necessary for prostate cancer "seem incompatible with prison dynamics, which has its own requirements for prisoners, as well as continuous releases."

The prosecutor and the popular accusations of the PP and Clean Hands have three days to rule on the entry or not in prison of the former president, sentenced to six years and one day in jail for the specific procedure of financing the fraudulent employment regulation files (ERE). Next, it will be the First Section of the Audience of Seville that will decide whether or not Griñán should enter prison despite his serious ailment.

The doctor lists a series of arguments in favor of Griñán being treated in the hospital and staying at home, but she is not conclusive in this regard and leaves the final decision in the hands of the judges. The "individualized and comprehensive" study of the facultative assesses the physical state of Griñán, but also the psychic and social, and emphasizes that there is "a physical and psychic affectation of his condition, in close relation to his age and his personal situation". Griñán is 76 years old. The former president is the only one of the eight former politicians convicted of embezzlement in the political piece of the ERE case who has not entered prison for the cancer he suffers.

The facultative concludes that "a disease of this entity" needs all the available resources that a person has at his disposal, "that is, family and social support", which would help Griñán overcome it. The specialist mentions that "hospital services outside the prison must be used" to treat the "high-risk" disease and for the side effects of radiotherapy, which require "close monitoring".

Next, he underlines how the penitentiary center of Seville 1 itself already mentioned in a previous report the "difficulties for the transfer in emergency situations and even before the scheduled departures of said center". That is, despite the fact that there are inmates who are treated in the hospital even while being held in prison thanks to punctual transfers, the prison management itself has acknowledged that it suffers "a great problem" for police transfers from prison to hospital.

The former president has received external radiotherapy throughout last March during 23 sessions that have produced secondary symptoms that have needed medication and rehabilitation exercises to alleviate them, and in parallel continues with his hormonal treatment. From now on Griñán will undergo a clinical and analytical control in June and September, and its periodicity will depend on its evolution and side effects.

After the ruling of the Hearing dated yesterday, the ball is in the roof of the Anticorruption Prosecutor's Office, the PP and Manos Limpias as popular accusations, which must pronounce on whether or not Griñán should enter prison. It will then be decided by the judges of the First Section. The usual thing in these cases is that the judges follow the recommendations of the doctors.
