A 28-year-old man from the Jerusalem area, who was brutally attacked five years ago by four patrons at a club in Rishon LeZion, recently filed a civil compensation claim against the attackers and against the owners of the club, Django Bar, for two and a half million shekels.

According to the lawsuit, filed on his behalf by attorney Itamar Ben-Ami, the serious incident occurred one night in December 2018. It is alleged that one of the four attackers put his hand on the plaintiff's shoulder, which he removed. As a result, an argument broke out between them and soon developed into a brawl, which was joined by the other three defendants.

The altercation was captured on security cameras, and the video shows one of the defendants punching the plaintiff in the head and knocking him to the floor of the club, with his friends kicking him in the head. Later, the plaintiff is seen getting up from the floor, and one of the defendants continues to beat him on the head, mercilessly, and strangle him from behind, knocking him to the floor again and kicking him in the buttocks and back.

According to Ben Ami, the club's owners not only did nothing to stop the fight, but even worse – they completely ignored it, and did not even bother to call the police and rescue forces.

Instead, it is alleged, the club's operators chose to remove everyone involved to the streets. According to Adv. Ben Ami, by doing so, the club's owners allowed, and even encouraged, the continuation of the plaintiff's assault, and prevented him from receiving medical treatment that could have reduced his damage.

According to Ben Ami, the club where the attack took place was operating without a license at the time of the incident and was closed after a while. Under it, a meat restaurant operating under the same name was established on the site, operated by the same owners, who were added to the suit as defendants.

The lawsuit claims that after the altercation, the plaintiff was rushed to Sheba Medical Center at Tel Hashomer, suffering from fractures in his lower jaw and numerous bruises all over his body, where he was hospitalized for three days. During his hospitalization, the plaintiff underwent surgery under general anesthesia in an attempt to rehabilitate his broken jaw, but the operation was partially successful, and today he suffers from chronic pain in the jaw joints, which increases when performing various activities, such as chewing food, talking, yawning and sneezing.

According to Attorney Ben Ami, in addition to the physical injury, the plaintiff also suffers from severe mental injuries. The statement of claim was accompanied by the medical opinion of Prof. Shlomo Barak, an expert in oral and maxillofacial surgery, who examined the plaintiff and determined that the functional disorder of the damaged jaw would remain permanent, and that there was no treatment that could improve his condition. Prof. Barak determined that the plaintiff had a weighted permanent disability of 25% due to his functional limitations.

"Mental disorder of significant intensity"

Another medical opinion, also attached to the lawsuit, by Dr. Eyal Asor, an expert in psychiatry, states that the plaintiff suffers from a mental disorder of significant intensity.

Attorney Ben Ami emphasizes in the lawsuit that the four young men who attacked the plaintiff have already been convicted in criminal law for this assault, and have been sentenced. According to him, the findings and conclusions in the criminal verdict handed down in their case constitute evidence that they did indeed carry out what is attributed to them.

According to him, before the attack, the plaintiff was a young man at the beginning of his employment career, with potential for personal and professional development in his field of activity. As a result, it is claimed, he needs, and will require many medical treatments, both physical and mental, and will suffer significant wage losses.

The lawsuit is currently being heard in the Bat Yam Magistrate's Court.
