The decision was signed by Horacio Rosatti, Juan Carlos Maqueda and Carlos Rosenkrantz, while Ricardo Lorenzetti did not vote because he did not intervene in the issuance of the precautionary measure that suspended the elections for governor and vice president.

Faced with this decision, President Alberto Fernández said that, "once again, the Supreme Court interferes in the democratic and autonomous process of the provinces. It has issued a sentence without the highest court of San Juan having previously given its opinion, attributing to itself an original competence based on a forced and illegitimate interpretation."

For his part, Uñac said that the highest court "overwhelmed any feature of federalism and violated the autonomy" of the province and produced "the cancellation of any type of hope of the people" of San Juan to elect "democratically, constitutionally and autonomously."

In a statement titled "Supreme Court to the autonomy of our people," the San Juan president said he will abide by the ruling "although he does not share, at all, a decision that reflects, in the worst possible way, the judicialization of politics."

"I will not be complicit in the manipulation of this election. That is why I want to turn this page and ask the Electoral Tribunal of the province to quickly set a new election date to define, without conditions and without new interference, the representatives of the government of our province for the next four years," he said.

The gubernatorial election was suspended by the Court on May 9, 5 days before the elections, by granting a precautionary measure requested by the libertarian candidate Sergio Vallejos.

Finally, on Sunday, May 14, the elections were held in the other categories: deputies, mayors and councilors, and the election of governor and vice president was pending.
