While the State Prosecutor's Office announced Monday morning that in the double murder case in Tulkarm, the police issued one judicial order based on information obtained by illegal spyware, it now turns out that there is another judicial order in the case that was illegally issued in a similar way.
The second spyware was implanted into a person who is neither one of the defendants nor among the witnesses in the trial, and was activated with the approval of Judge Ron Sokol in April 2021. The spyware extracted information that went beyond the judge's approval.
Documentation of the assassination of the brothers in Tulkarm
The officers of the Signal Unit who operate the spyware illegally reviewed the prohibited information and handed over some of it to the investigation team of the case. They approached another judge and, on the basis of the prohibited information, sought another judicial order without informing them that the information establishing the order was obtained illegally.
Due to the non-reporting, the judge approved this order and even activated and through it information was obtained, but after analysis was not found relevant to the case and was not submitted with the evidence. In addition, in the double murder case in Tulkarm, the spyware deviated from a third additional operation and extracted materials in violation of the court order, but in this case the information was not used.
Marari Report
The partial announcement by the State Prosecutor's Office and the information revealed in Israel Hayom now is important because the Marari report, which examined the use of spyware, did not find files in which a person examined materials extracted illegally, and certainly no materials were used in interrogations – this is due to the fact that the examination is only sample and partial.
The submarine file and the Prime Minister's files also revealed that duly installed spyware drew information that deviated from the judicial order, but it was reported that it was not used. Now, for the first time, a case is being discovered in which police officers not only reviewed the information, but also used it in investigations. The prohibited information was even presented to the court in order to obtain judicial orders without informing the judge, as stated, that the information was illegal.
