Fantastic location for every poster company

Highlights: Two advertising banners are already "decorating" the timber warehouses on the B307 in Agatharied. The Hausham building committee has received an application for two more "wall-mounted large areas" for this location. According to the municipal advertising system statute, a "disturbing accumulation" of those banners was inadmissible. However, the municipality could throw the proposal made by the property owner to remove the existing, free-standing billboard on the long side of the hall as a pound.

It's a dream location for any poster company. The Haushamer building committee has now discussed further billboards on the B307 in Agatharied.

Hausham – A heavily frequented and, on top of that, often congested federal highway: What mainly annoys motorists and residents is a premium location for advertising companies. For example, two advertising banners are already "decorating" the timber warehouses on the B307 diagonally opposite the Gasthof Staudenhäusl in Agatharied. Now the Hausham building committee has received an application for two more "wall-mounted large areas" for this location. As Petra Sperl, head of the building authority, explained, the company Ströer Außenwerbung wants to install the 3.83-metre-wide and 2.83-metre-high panels with aluminium frames on the south sides of the two street-side buildings.

No objections under planning law, but...

In terms of planning law, there is nothing to be said against the advertising facilities, as the sawmill property is located in the industrial estate. Unlike in February 2022, when a 2.75 by 8 meter long board was requested, the dimensions of which were rejected by the road construction office and the police alike because of the threat of distraction of motorists, this argument could now no longer be used because of the significantly slimmed-down size. Nevertheless, Sperl had identified a possible obstacle to the two additional boards: According to the municipal advertising system statute, a "disturbing accumulation" of those banners was inadmissible. However, it is not more precisely defined from which number this limit is reached.

"Agatharied should retain its village character"

The building committee members were also unsure how to handle the application. "Agatharied should retain its village character," said Harda von Poser (Greens). In addition, the municipality has no influence on which products are advertised on the food banks. Poser therefore asked whether the use could be limited to domestic companies. Mayor Jens Zangenfeind (FWG) shook his head. From a purely formal point of view, the advertising is a separate company, which cannot simply be prohibited in the industrial park.

Only three billboards instead of four

According to Sperl, however, the municipality could throw the proposal made by the property owner to remove the existing, free-standing billboard on the long side of the hall as a pound. "Then there would be only three instead of four." Zangenfeind recommended that the committee approve the application, but to link its execution by the town hall to the dismantling of the existing building. Especially since in the event of a negative decision, there is a risk that the municipal agreement will be replaced by the district office. "Then in the end we will have four advertising systems," explained the head of the town hall.

Michael Ertl (SPD) nevertheless preferred to reject the application. "We have a statute, so we also refer to it," he said. In the end, the other committee members also agreed to this. They unanimously rejected the proposed resolution – but with the protocol note that they wanted to reassess the matter after the existing billboard had been removed by the owner.
