"Radentscheid Bayern" smashed: Planned referendum has failed

The Constitutional Court has ruled on the approval of the "Radentscheid Bayern" – and rejected the referendum.

Update from 7 June, 10.55 a.m.: The planned referendum for a new cycling law in Bavaria has failed before the Constitutional Court. Court President Hans-Joachim Hessler announced on Wednesday that the requirements for admission were not met.

The court justified the rejection of the "Radentscheid Bayern" primarily with the fact that some of the required regulations would interfere with the legislative competence of the federal government.

Munich – At the end of May, the CSU and the Free Voters presented a draft for a new bicycle law. By 2030, 1500 kilometres of new cycle paths and a state-wide cycle network are to be created in Bavaria, according to BR.

For many people, however, this does not go far enough, and a referendum is intended to correct this. Its initiators want 2030 percent of all journeys to be made by bike by 25. This is the declared goal of the "Radentscheid Bayern" – the approval of which will be decided by the Constitutional Court on Wednesday, 7 June.

In order to reach the 25 percent mark, more high-speed cycle connections and more bicycle traffic in one-way streets are to be created. Cycling must also become safer, demands Bernadette Felsch, representative of the referendum and chairwoman of the ADFC (General German Bicycle Club) of Bavaria, according to the BR. To this end, all hurdles have been overcome to bring the referendum into politics.

Nevertheless, the Ministry of the Interior considers the "Radentscheid Bayern" to be inadmissible. The costs for implementation, as demanded by the referendum, are too high – and would thus represent an encroachment on the budget sovereignty of the state parliament. This is not possible by virtue of the constitution.

ADFC contradicts politics – how does the Constitutional Court decide?

Of course, the ADFC sees the matter of budget sovereignty differently. According to Felsch, the cost calculation is far too high, among other things, the Ministry of the Interior has included investments already made in its cost statement and federal subsidies have been disregarded.

Among other things, the Constitutional Court is now deciding on this matter and is getting to the bottom of the question of whether the financial intervention of the referendum goes too far or not. If the green light is given here, approval is granted. According to BR, ten percent of the electorate will then have to sign a petition in their town halls for the "Radentscheid Bayern" – i.e. about one million people. If the state parliament does not accept the bill, a Bavaria-wide referendum will be held. (FHZ)
