The Southern District Prosecutor's Office recently filed an indictment in the Beer Sheva Magistrate's Court against Ashdod Port employees Max Alaluf (50) and Yaakov Kedar (50) from Ashdod, after due to their negligence, while unloading tin cylinders, the cylinders broke off and caused the death of David Tatarashvili.
The indictment filed by attorney Renana Levy indicates that during the relevant period, Kedar worked as a foreman at the port and Alaluf, who was subordinate to these, worked as a shovel at the port. On February 13, 2020, Kedar was in charge of several teams, including Alaluf's team, which consisted of a team of 4 severs who were subordinate to him, including the deceased. The team's goal was to unload large tin cylinders made of metal, each weighing between 9 and 12 tons.

In order for the tin cylinders not to roll, they were tied with cables and had to be unloaded according to procedures. Notwithstanding the foregoing, Alaluf, being responsible for his subordinate employees, violated the safety regulations of the port. Among other things, it is possible to drive a forklift without a permit, teared the tying devices that held the tin cylinders with the forklift fork and did not wait for the authorized person, dismantled the tin cylinders not in accordance with the procedures, and did not even use wooden beams to prevent the deterioration of the remaining cylinders.
Due to Alaluf's actions, and due to Kedar's failure to supervise the work and ensure that port procedures are followed, with regard to the safety of unloading the cylinders, the cylinders were released from the cables, rolled down from their row towards the shipyard floor and hit the deceased, who at this stage was engaged in his work on the ship's floor, near the rows of cylinders.
As a result of the accident, the deceased was taken to the hospital and died a few hours later in the hospital.
