The regional wind planning for the centre of Schleswig-Holstein is here to stay. The Higher Administrative Court (OVG) in Schleswig dismissed two lawsuits against the plan for the independent cities of Kiel and Neumünster as well as the districts of Plön and Rendsburg-Eckernförde as unfounded. This was announced by the court on Wednesday. The complaint was filed by the municipality of Krummbek (Plön district) and a farmer from the Rendsburg-Eckernförde district.

The municipality wanted to prevent a priority area for wind energy use with a size of about 27 hectares on its territory. It is of the opinion that the area is too close to the district of Ratjendorf and that the municipality is thus hindered in its municipal planning. The court did not agree with this.
The farmer, on the other hand, wanted some of her land to be designated as a priority area. She criticized individual taboo criteria and their concrete implementation. The OVG could not understand this criticism. Some of the criteria are already binding and are within a margin of consideration.
The proceedings heard on Tuesday and Wednesday were the second proceedings against the regional plans for the expansion of wind energy, which came into force at the end of 2020. In March, the OVG overturned the plan for the north of the country. This judgment is not yet final. In addition, there are more than 40 other lawsuits against the plan for the south of the country.
