Four days before the date on which he was to begin trial, the Criminal Court No. 3 of Quilmes dismissed Jorge Ríos (73), the retiree who killed the thief Franco "Piolo" Moreyra in that party in the south of Greater Buenos Aires. In this way, the jury trial that was to begin next Monday will not take place.
The resolution came hours after the request of prosecutor Andrés Nieva Woodgate, who endorsed a presentation by lawyers Marino Cid Aparicio, Fernando Soto and Martín Sarubbi. "Order the dismissal of Jorge Adolfo Ríos, in order to the fact qualified as homicide, aggravated by the use of a firearm," the court ruled.
In addition, it annulled the judicial procedure that was going to take place in four successive hearings between Monday and next Thursday.
Rios was caught at his home on July 17, 2020, in the middle of the night. A group of five criminals broke into the house. Moreyra (26) attacked him with a screwdriver and threatened him.
The victim defended himself with his Bersa Thunder 9-millimeter pistol and fired several shotsin the yard. As seen in security camera footage, Moreyra was left behind in the escape because he was wounded. He walked limping until he fell into the corner. Rios, who was armed, approached him and kicked him.
