A 22-year-old from Penzberg had requested, among other things, nude pictures from underage girls. Juvenile criminal law saved the young man from imprisonment, but he did not get away with it.

Penzberg – "I admit all allegations," said the 22-year-old accused after the reading of the indictment. Already with the police, he had made no effort to deny the acts, said a police officer. In this respect, the handling of the defendant and the processing of the case was "very pleasant".

The young man was guilty of numerous crimes in the period from 2017 to 2020. In several cases, he is said to have asked girls under the age of 14 for nude pictures or photos in underwear on social networks such as WhatsApp, Instagram or Skype, or to have demanded such pictures in return for the shots of his penis and videos showing him masturbating. In addition, he had told them several times about his sexual fantasies, asked the injured parties about sexual preferences or demanded that they arouse him.

"Girls of different ages"

Some have actually complied with the demands for images. In one case, the defendant is even said to have taken pictures of a girl himself. As the evaluation of his data carriers had shown, there had been an exchange of criminally relevant material in some group and private chats, said another police officer.

In addition to the chat histories "with girls of different ages", the evaluation also revealed over 2700 image and video files showing a wide variety of sexual acts among adults, adolescents and children. The recordings, which he had not made himself or received from the underage girls, were "all from the Internet," the 22-year-old explained.

"Exaggerated confession"

The prosecutor credited the defendant positively with having spared the court a lengthy taking of evidence through his apology and the "excessive confession". The injured parties did not have to be questioned by the police, his defense lawyer added.

The fact that the Penzberger has been suffering from depression for about seven years "inhibits the development of personality," according to the prosecutor. Just like the juvenile court assistance and the defense lawyer, he therefore came to the conclusion that juvenile criminal law should be used.

Court of lay judges imposes suspended sentence

The court of lay judges led by Judge Franziska Braun then imposed a one-year juvenile sentence suspended on probation, as well as a fine of 1000 euros, which is to benefit the "Tabaluga Children's Foundation". In addition to sexual abuse and the distribution, acquisition and possession of child pornography files, the violation of the highly personal sphere of life through image recordings was also included in the verdict. However, the court found the defendant's previous efforts to obtain sex therapy to be insufficient, which is why this was also imposed on him.
