For example, the motorcyclist had overtaken the car of a woman from Deiningen a few 100 meters before the accident site, shortly before the permitted maximum speed in the intersection area is reduced to 70 kilometers per hour. Whether the biker had reacted to this was "technically no longer detectable" on the basis of the pile of debris left over from the machine, the expert explained. According to their calculations, however, the motorcycle was traveling at a speed of 80 to 90 km/h. The motor vehicle expert came to the conclusion: "At 70 km/h it would have been tight, but the Yamaha would have been able to brake in time."

In view of the "enormous contributory negligence of the motorcyclist", whose blood had also tested positive for cannabinoids, the defence considered it appropriate to discontinue the proceedings under Section 153a (against payment of a fine). That was out of the question for the public prosecutor's office. She sees the tragedy and that it is "very, very burdensome" on the defendant, the prosecutor explained. "But as a result, it's a breach of due diligence, and in the end, a person is dead. That's why I can't agree to a hire."

Judge Berger sentenced the woman to 90 daily rates (the prosecutor had applied for 120) to 70 euros each, a total of 6300 euros, and imposed a one-month driving ban. "The burden that they have to continue to bear cannot be taken away from you," Berger said in his verdict.
