The deputies of the France Insoumise want to open the PMA to transgender men

The deputies of the France insoumise (LFI) presented Wednesday a bill to demand again the opening of the ART to transgender men, born biologically female and able to have a gestation. "Transgender men, people born biologically female who transition to the masculine and / or fluid gender, with gestational capacities, can not use ART (medically assisted procreation, also called MAP) for the sole reason of the mention of their sex in the civil registry," lamented the elected rebel Ségolène Amiot, at a press conference at the National Assembly.

"A mention in the civil status should not hinder the kinship," she insisted with her colleague Bastien Lachaud. The "bioethics" law of August 2021 extended access to ART to female couples and single women. In July 2022, the Constitutional Council had validated the exclusion of transgender men from access to ART. A provision challenged by an association for the defense of trans people.

In addition to the opening of ART to transgenders, Ségolène Amiot's text plans to sanctify the self-preservation of gametes for all people. "The change of sex designation makes uncertain today the use of gametes by couples," argued the deputy of Loire-Atlantique.

Whirlwind in the LFI group

His bill, which is not on the agenda of the National Assembly, would also make possible the technique known as "reception of oocytes from the partner" or ROPA, which allows a woman to donate an oocyte to her partner, for assisted reproduction. This technique, authorized in Spain, had been discussed but rejected in previous debates on French bioethics laws, some seeing it as a shift towards surrogacy. "There is neither near nor far with this bill the possibility of resorting to surrogacy," defended Ségolène Amiot.

Finally, its text provides that the procedure for early joint recognition of a child be extended to all couples, including those whose "man gives birth to the child". During the previous five-year term, LFI deputies Bastien Lachaud and Danièle Obono had tabled a similar bill to "make medically assisted procreation a universal right".

The group experienced turmoil in early June on the issue of LGBT+ rights when François Ruffin had dismissed a law on gender change in the name of "appeasement". Several rebellious elected officials had criticized a "personal" position, and the deputy of the Somme, potential candidate for the presidential election of 2027, had made amends and acknowledged having to "progress" on this issue.
