The Verdi union is calling for an all-day warning strike on public transport.

Passengers in Bavaria initially have nothing to fear.

Munich – The whole of Germany is affected by a warning strike in local public transport on Friday (February 2nd).

Whole Germany?

No!

There is one federal state in the south of the republic that is spared: Bavaria.

The subway, bus and tram run there regularly on Friday.

Nationwide warning strike in public transport: The “duty of peace” applies in Bavaria

The Verdi union called for the all-day warning strikes.

“Since collective bargaining has now taken place in all federal states and has not produced any results, now is the time to put more pressure on employers,” said Verdi’s deputy federal chairwoman, Christine Behle, on Monday (January 29) in Berlin with.

Further discussions are planned in Bavaria.

“However, the collective agreement was extended a year ago.

Therefore, there is a duty of peace in Bavarian public transport and no strikes are to be expected,” said the Verdi regional district of Bavaria on Monday.

The corresponding contract is valid until the end of 2024. In the 15 other federal states, a “peace obligation” no longer applies since January 1st.

What does the “duty of peace” mean for trade unions?

The union is not entitled to strike during a collective agreement that has not been terminated.

The peace obligation only ends after the notice period has expired.

Individual collective agreements stipulate that forced strikes (not warning strikes) may only be carried out after negotiations have officially failed and subsequent arbitration has taken place.

Verdi is also negotiating in Bavaria: “Improvements to working conditions in the center”

According to Verdi, each tariff area has its own requirements.

Particular attention is being paid nationwide to shortening weekly working hours, increasing holiday entitlement and additional relief days for shift and night work.

“In Bavaria, too, improvements in working conditions and, above all, relief for employees are at the center of the negotiations,” the state district said in a statement.

“Only through significant improvements in working conditions will it be possible to attract enough skilled workers for Bavaria in the future,” said Katharina Wagner, department secretary in the Bavarian state department for public and private services, social security and transport.

The start of negotiations for the Free State is scheduled to take place on February 9th in Nuremberg.

Passengers in Munich and Bavaria are initially not affected by any further restrictions.

It was only on Monday that the German Locomotive Drivers' Union (GDL) prematurely ended its multi-day strike at Deutsche Bahn.

A peace obligation now applies there until March 3rd.
