The Knesset committee will convene this morning (Monday) to discuss a request to remove from the Knesset MK Ofer Kasif, from the Hadash party.
This is because Kassif signed a petition supporting South Africa's petition to the International Court of Justice in The Hague in which it is alleged that Israel is committing genocide in the Gaza Strip, and because of Kassif's publications on social media in which it is claimed that Israel is committing war crimes.
The move was initiated by MK Oded Forer from the Israel Beitenu party - so far 87 members of the Knesset have joined him.

How do you impeach a Knesset member?
In 2016, the Knesset approved the "Impeachment Law" which allows Knesset members to remove a sitting MK. 62 Knesset members voted in favor of the law, and later the High Court of Justice qualified the law on the grounds that it has "checks and checks".
According to the law, the Knesset plenum can impeach a MK for inciting racism and supporting an armed struggle against the State of Israel, provided that the impeachment is supported by 90 Knesset members.
There are three stages to the impeachment procedure: the first began after 70 Knesset members signed the impeachment request, including 10 Knesset members from the opposition.
In the second stage, the Knesset committee will approve the request to impeach the MK with a majority of 75% of its members, and in the third stage, the impeachment will be put to a vote in the plenum and 90 Knesset members are required to support it.

Has a sitting MK ever been impeached under the impeachment law?
No.
In January 2017, a few months after the approval of the law, a request was submitted to terminate the tenure of former MK Basel Gatts.
The request was submitted on the basis of an indictment filed against him for transferring phones and documents to terrorists in Israeli prisons.
The Knesset committee held one discussion on his impeachment, during which it became clear that the former MK was conducting negotiations for a plea agreement in the framework of which he would resign from the Knesset.
A few days later, the settlement with him was signed, he resigned from the Knesset, and the impeachment procedure was unnecessary.
In the hearing against Gats, it emerged that the legal advisor to the Knesset and the legal advisor to the government believed that significant evidence was required to continue the proceedings in his case.

Is there a chance to oust MK Kasif?
So far, 87 members of the Knesset from most of the House factions have signed the impeachment request of MK Kasif, with the exception of members of the Knesset from the Labor, Hadash-Ta'al and Ra'am factions.
Prime Minister Benjamin Netanyahu, opposition leader Yair Lapid and ministers Benny Gantz and Gadi Eisenkot have not yet signed the request, as have 9 MKs from the Yesh Atid faction.
However, this is the highest number of Knesset members who have signed this type of procedure to date, and MK Oded Forer from Israel Beitenu who initiated the impeachment, collected the signatures and works against Kasif believes that there will be a majority of 90 MKs in the plenary.

The Knesset estimates that even if a Kasif MK is removed by a majority of 90 members of the Knesset, a petition will be submitted to the High Court, during which it will be decided whether to legalize the removal or cancel it.
The Knesset Speaker, Attorney Sagit Afik, yesterday sent a legal document to Knesset members in which she reviewed the legal angles for this type of procedure and emphasized the committee's duty to give MK Kasif, the legal advisor to the government and the legal advisor to the Knesset to voice their opinion even before the vote.
She also emphasized the importance of the request for disqualification being based on one of two grounds for disqualifying a sitting MK: inciting racism and supporting an armed struggle against the State of Israel.
