The Court of Navarra has confirmed a 25-month prison sentence for rapper Black Marfil (Junior O.) for threatening to kill the Pamplona Municipal Police in his songs, with whom he has had frequent altercations.

The now convicted man is a reference of the so-called

drill

music - a subgenre of

trap

, with raw and violent protest lyrics - he was denounced after posting the song

Fuck a cripa 02

on networks , where he repeatedly sings the phrase "run

sinpa

[without papers ] to kill the son of a

munipa [municipal]

", which for the court is a credible threat, since it represents "an announcement of an evil that constitutes a crime", without it being necessary for "any attack on no son of a

munipa

.”

Black Marfil joins the list of rappers convicted for the content of his songs, such as Valtònyc (José Miguel Arena) and Hasél (Pablo Rivadulla), these for insulting the Crown.

The sentence, which confirms the one already imposed by the Criminal Court number 3 of Pamplona for “non-conditional collective threats”, highlights that in many of the songs released by the convicted person “violence is encouraged and its use as a normal form is justified. of relationship and social coexistence.”

The ruling recalls that in January 2020 he published another song under the title

Atraco

in which “explicit reference to killing a police officer” was made, since it indicated: “If you kill a police officer, plus five.”

The song for which he has now been convicted contains the expression “kill the son of a munipa”, which “seems like the chorus”, and throughout the lyrics ideas are given about how to carry out this death and weapons are displayed, including an AK-47.

The song, which in February 2021 had almost 48,000 views, "contains an advertisement for an evil that constitutes a crime", a threat that "gains importance (...) given its impact and following on social networks."

The judges explain that the rapper “is very well known among young people between 14 and 20 years old” both in Pamplona and in the rest of Spain, given his activity on Instagram (22,600 followers) and YouTube (20,100 subscribers and 2,128,093 views when the ruling was made). the original sentence).

Magistrates say the singer's own criminal history makes his verbal attacks on police even more relevant.

Since July 2018, the Pamplona Municipal Police intervened on numerous occasions with the accused “on the occasion of fights and threats”, weapons were seized from him and “he was even investigated for a crime of belonging to a criminal group”, the judges stated.

In fact, the sentence believes that the song that the rapper uploaded to his YouTube account on June 21, 2020 is motivated by “the animosity” of the accused towards the municipal officials.

The ruling recalls “the aggressive nature and criminal acts perpetrated by the defendant, already convicted of threats, injuries and robbery crimes,” as well as that during police interventions “weapons were seized.”

“All this, together with the discomfort felt by the Municipal Police, entails, in the opinion of the Court, that the requirement of intimidation necessary in the crime of threats is met,” as reported by the Judiciary on the content of the sentence.

The magistrates conclude that in this case it is not about “prosecuting a certain musical genre, since it is not judged by songs that have “violent content”, but rather by meeting all the arguments previously stated and therefore the requirements of the type of threats. of article 170-1 of the Penal Code.
