After the "Israel Hayom" revelation:

the military attorney's office retracted and announced today (Tuesday) that it will drop the indictment filed against the senior attorney Amri Koffler.

The return of the indictment was made due to the reductions made by the police traffic accident examiner in the findings of the accident, as published.

Kopel was accused in the traffic court in Petah Tikva, of causing the death by negligent driving of Esther Mizrahi, 88 years old. According to the indictment, he ran over her when she was crossing a crosswalk.

He was also charged with speeding and failure to slow down.

This is the first time in Israel that an indictment has been filed against an incumbent attorney.

Since Koffler works at the state attorney's office, the case was transferred to the military attorney's office.

However, as revealed in "Israel Hayom", traffic accident investigator Sergeant Shmuel Shalman from the Sharon region, admitted that he simplified the findings of the accident with Koffler. According to his testimony, in the reconstruction of the accident it was determined that Mizrahi's walking pace was slow, but in the report a pace was determined Walking faster - something that benefits Kupler, since it was harder for him to notice her that way.

The same with the driver's reaction time.

According to the reconstruction, the reaction time should have been faster, but a slow reaction time was determined and this figure also works in the driver's favor.

Another and central parameter is the speed at which Koffler was driving on a road where the speed limit is 40 km/h. According to his testimony, Koffler was driving over 80 km/h - this according to a calculation at what speed the accident would have been avoided - despite this, the accident file states that Koffler was driving at a speed of 50- 60 km/h. The examiner testified: "We also don't have the speed of the vehicle, that it was traveling over 80 km/h when the speed limit is 40 km/h.

According to the quadratic equation we did, if he had traveled less than 83 km/h, the accident would have been avoided."

The findings of the accident according to the examiner show a very borderline fault of the driver.

Koffler claimed that with such data no indictment is filed.

As a result, the court referred the case to mediation and today it was decided to cancel the indictment.

Uri Nahmias, attorney for Mizrahi's family: "The family feels as if Esther was run over for the second time. It was forbidden to drop the indictment, especially since there is a police examiner here who says he made light of it. For that reason alone, the case should have been continued. The police examiner He clearly said that he facilitated and changed data. This is part of the system and it is very, very unfortunate. It is unfortunate that because a senior prosecutor is speaking, then the system allows itself to engineer evidence. This has no place in the State of Israel. This indicates the cleanliness of the hands of the Israel Police and the law enforcement agencies in relation to this investigation. It is unfortunate that one citizen is preferred over another just because of his position and status."

The response of the IDF spokesman: "After the beginning of the evidence procedure, there were evidentiary developments during the hearing of the witnesses in the case.

Following this, a mediation session was held before a mediator judge.

In view of the findings that emerged during the conduct of the trial and the comments of the judge in the mediation process, the prosecution asked the court to order the cancellation of the indictment, and its request was granted.

The representatives of the prosecutor's office were in regular contact with the family of the victim of the crime and informed them of their aforementioned decision."
