A young man from Tölz is on trial for, among other things, raping a 13-year-old.

The defendant denies the allegations.

Bad Tölz/Wolfratshausen – Two young people get to know each other on an online platform.

They become friends, meet, have sex.

A few months later, the relationship ended abruptly.

With devastating consequences.

The man, a 21-year-old from Tölz, has been standing trial since Tuesday for serious sexual abuse and rape before the youth jury court at the Wolfratshausen district court.

The trained salesman is said to have known that the student was only 13 years old when he - then 19 - entered into a relationship with her.

The defendant firmly denies this, as well as the main accusation of the prosecution: he is said to have raped the girl in a supermarket parking lot in Peiting (Weilheim-Schongau district) in the days between Christmas and New Year's Eve 2021.

Nothing ever happened “that wasn’t okay”

“Both accusations are false,” the defendant explained through his defense attorney Jost Hartman-Hilter in a “statement of fact” comprising several A4 pages.

Age wasn't an issue at first.

“She said she was 15. She seemed older,” said the accused in his statement.

However, she asked him to “state an age under 18” to her father, meaning that he himself was under 18 years old.

Opinions differ as to what age was given: “17,” the defendant said, “15,” the girl’s parents said.

During the period of the crime - according to the indictment, from the beginning of June to the end of December 2021 - the Tölzer repeatedly stayed overnight with the student, who lived with her father.

She also sometimes slept with him after her father or mother had brought her to Bad Tölz.

It was “never an issue that something happened that wasn’t okay,” the lawyer continued.

His mandate accompanied every sentence with head nods.

“There was no sexual contact” in the supermarket parking lot

The young man vehemently denied the incident in the supermarket parking lot.

According to his memory, there was an argument between him and his girlfriend that day in the square where they regularly met with friends.

He therefore pulled her into a narrow corridor on the premises so as not to have the argument aired in front of her friends, who were also there.

“There was a scene there, but no sexual contact,” said the defendant.

It sounded completely different from the student's mouth.

Their two-and-a-half-hour judicial interrogation, which was broadcast on a large screen in the hearing room, took up a lot of space on the first day of the hearing.

He pulled her into a niche, pushed her down on her knees and forced her to satisfy him orally, the student said, interrupted by tears and sobs.

She was close to despair when the judge asked her several times because he wanted to know exactly how the situation had happened.

Girl was “devastated” after the breakup

The teenager admitted during her interrogation that she had had sexual intercourse for the first time at the age of eleven, with her very first boyfriend.

She also did not hide the fact that she sometimes had sex with older men in their mid-20s for money in order to finance her drug use at the time.

“He didn’t do anything that I didn’t already know,” said the student when asked about the sexual practices with the defendant.

After the relationship abruptly broke down shortly after the incident at the supermarket, her daughter was “mentally and physically exhausted,” the mother reported.

“Not sad,” she replied to the defense’s question, she was “devastated.”

The girl spent two months in a children's clinic and then lived in a residential home for a year.

Today she lives with her again, the mother reported.

“She’s getting an education and trying to get her life back on track.”

Parents: “He knew she was 13, one hundred percent”

According to their statements, both parents were unable to stop the criminal behavior.

“I wasn’t thrilled,” explained the mother, but “he was quite likeable.

I couldn't say anything against him." Father and mother only agreed on one point: "He knew that she was 13, one hundred percent.

She was always open about her age.”

At the beginning of her online contact she lied to him, but before their first meeting she revealed her real age, the student reported in her video interrogation.

She also said that she didn't always feel like having sex.

“I often didn't want to, but I did it anyway,” said the girl.

The judge wanted to know why she didn't leave.

The student replied: “He was my first real love.

That's why the collapse came afterwards." The process will continue.
