Chaotic scenes at the Murnau folk festival.

A Reichersbeurer injures two police officers.

Now he has been sentenced to a fine.

Murnau/Reichersbeuern –

Brawl at the Murnau folk festival, two men got into a fight with security.

The police are called and find a confusing situation.

Who is one of the thugs, who is a witness, who is a bystander?

A young man then gets into a scuffle with the police in the commotion in front of the festival tent.

With serious consequences – two officers are injured.

Now the 24-year-old from Reichersbeuern had to answer before the Garmisch-Partenkirchen district court for the attack on law enforcement officers.

Judge Andreas Pfisterer sentenced him to a fine of 5,400 euros.

The defendant did not want to comment on the incident on August 13, 2021, but had a statement made through lawyer Lisa Stölzle.

He wanted to inquire about the police officers who were involved in the fight.

He couldn't remember the incident in front of the beer tent - he had a blood alcohol level of 1.81 and also smoked cannabis.

The defense attorney did not hesitate to criticize the law enforcement officers' actions: her client had not been informed that he was a candidate as a witness.

“The police action was unlawful,” she emphasized.

The defendant did not understand why the police were holding him.

“He never knew what was going on,” said Stölzle.

Body Cam Footage: “He hit my face and scratched me under the eyes”

A total of seven officers testified as witnesses.

There were also body camera recordings showing the hysterically screaming 24-year-old.

He's constantly screaming for a lawyer and complaining loudly that he's handcuffed.

“How did it escalate?” Pfisterer asked the officer, whom the defendant injured in the face and hand.

The accused stood in front of him with his hands in his trouser pockets.

“I didn’t know what he had in his pants,” said the chief detective, describing the situation.

His fear: The man might pull out a gun.

To protect himself, he grabbed the visibly drunk man.

“He punched me in the face and scratched me under the eyes,” said the chief detective, who finally brought the defendant to the ground.

At the Murnau Folk Festival: The situation continues to escalate

A police chief reported that the situation with the accused was becoming increasingly heated.

The 32-year-old - she was slightly injured in the incident - tied him up, causing him to block himself and resist.

“He had extreme mood swings, was sometimes aggressive, sometimes tearful, sometimes angry,” said the officer to whom the defendant apologized in the meeting room.

The Reichersbeurer carried out a perpetrator-victim mediation with the injured chief detective.

“Against my advice,” complained the defense attorney, who considered the payment of 1,500 euros to the officer to be wrong.

The police officer, on the other hand, reported that he got to know the 24-year-old as a completely different person while dealing with the conflict.

“You can talk to him when he’s sober.”

The lawyer demanded an acquittal for her client.

“From my point of view, it went really wrong,” she said, criticizing the police’s behavior.

The injured officer should have let the accused go first.

The defendant rightly defended himself and said his act was not a criminal offence.

The defendant gets away with a fine

Theo Bezold saw it completely differently, as he credited the 24-year-old with recognizing his guilt and showing remorse.

“But the defendant resisted police action over a long period of time,” said the public prosecutor, who demanded a one-year suspended sentence for assault and intentional bodily harm.

Pfisterer settled for a fine.

For the 24-year-old, who has no criminal record, it is the third time that the same proceedings have been opened against him.

The main hearing was suspended twice because the public prosecutor's office did not agree to stop it.

In addition, the perpetrator-victim reconciliation was “very successful”.

However, what weighed heavily on the judge was the defendant's attack and the massive injuries to the officer, who was unable to work for six weeks.

In addition, Pfisterer considered his behavior to be appropriate to avert danger.

The situation after the fight in the Murnau beer tent had not yet been resolved, “the official act was lawful”.
