Masterson does intend to appeal his sentence, but last week Judge Charlene Olmedo denied his request to be released on bail until the end of the proceedings.
Olmedo explained in her decision that Masterson might try to flee the country, since he has no reason to return to prison on his own initiative in order to complete his lengthy sentence - this is on the reasonable assumption that his appeal will be rejected.
