Because he did not report his new job and collect state aid, a 30-year-old man from Moosach had to answer before the Ebersberg district court.

Ebersberg/Moosach – A 30-year-old man received social benefits from the employment agency for four months, even though he had already had a job.

The Moosacher now had to answer for fraud before the Ebersberg district court.

The man confessed in the dock.

“I reported this much too late at the time.

“I made a mistake,” he asserts.

Moosacher collects unemployment benefit: Job center only becomes aware of fraud after three months

Freshly released from the Landshut correctional facility - where he was imprisoned for eleven months for grievous bodily harm - the Moosacher registered as unemployed in August 2022.

He had been looking for a job for over a year - without success.

It wasn't until January 2023 that he found a job as a salesman at the Netto discount chain.

However, the defendant did not inform the job center of his new employment, so he continued to receive social benefits of almost 800 euros per month.

Through a data comparison, a clerk only discovered the fraud three months later.

“In March we became aware that the defendant was unfairly receiving benefits,” the responsible employee reported in court.

The authorities then asked Moosacher for a statement several times.

However, the letters all remained unanswered.

At the end of March, the job center finally stopped payments - but the maintenance payment was still credited to the defendant's account for the following month of April.

In total, the Moosacher defrauded the state of more than 3,000 euros.

“A significant sum,” noted Judge Frank Gellhaus.

The defendant has already paid back part of the amount.

However, due to an accident on the way to his new training facility, he had to stop making payments again.

“I was fired two months after starting my training because I had been on sick leave until now,” said the man, who is currently living on citizen’s benefit again.

He definitely wants to continue his training as a chef, but he hasn't found a suitable company yet.

The public prosecutor viewed this willingness to act in Moosacher's favor.

Since the 30-year-old already has a relevant criminal record, she demanded a fine of 1,800 euros and a confiscation of the value of the damage, i.e. almost 3,100 euros.

However, given the 30-year-old's current life situation, he warned: "If this happens again with further services, you will have one foot in prison."
