A 33-year-old Geretsrieder was sentenced to three years in prison at the Wolfratshausen district court for child pornography and fraud.

Geretsried – The defendant was determined to come clean.

“I make a full confession.

It wouldn't do any good if I glossed over something.

“That was both wrong,” said the Geretsrieder, who had to answer to the lay judges at the Wolfratshausen district court for two charges: namely the distribution, acquisition and possession of child and youth pornography and fraud.

The unemployed man, who had already been unemployed several times - including previous convictions - was sentenced to three years in prison.

During a house search in April 2022, 19 images of child pornography and one video were found on the 33-year-old's cell phone.

A year later, he applied for unemployment benefit II at the job center and presented a rental certificate that did not correspond to his actual living situation.

So he received 6,936 euros, to which he was not entitled.

While the defendant tried to appear reformed in court, a detective was not impressed by the new facade.

“He was on the radar for sexual offenses after his release from prison,” explained the police officer, who had had to deal with the accused more frequently in recent years.

“I got to know him as a difficult guy,” said the officer.

His impression: “When you tell him something, he listens for a moment, but basically he doesn’t care.”

But that should be over now.

“I want to throw my previous life overboard and do something with it,” the defendant asserted.

Not least because he has a new girlfriend who “is completely behind me.

“I’ve blossomed since then,” said the Geretsrieder.

The couple will be able to take their time with this.

The jury found the 33-year-old guilty of both charges and sentenced him to three years in prison.

The court also ordered the confiscation of 6,936 euros - the amount he received from the job center.

“We think we heard a certain amount of remorse,” explained judge Helmut Berger in his verdict.

He made it clear: “If the confession had not come, we would have been approaching the maximum four years we are allowed to give.”

Ultimately, however, the court was probably not completely convinced by the defendant's stated change of mind and lifestyle.

Because of the three-year prison sentence, there is “an increased incentive to flee,” said Judge Berger, explaining why he ordered the 33-year-old to be taken into custody, as requested by the public prosecutor.

The man had already fled once, before the first trial date in September.

He was then wanted by an arrest warrant and, after his arrest, was brought back from the prison for a new main hearing.
