There is renewed speculation about the return of the insolvent airline Air Berlin.

The reason is an entry in the commercial register at the Charlottenburg district court.

In the summer of 2017, the second largest German airline, Air Berlin, filed for bankruptcy and had to stop flight operations the following fall.

After that, for a long time there was no one who wanted to secure the trademark rights - until Marcos Rossello, the founder of the airline Sundair, came along in the summer of 2023.

He bought the brand name for around 120,000 euros and had the brand entered in the commercial register.

Now, at the end of 2023, a new company called “Airberlin Luftverkehrsgesellschaft mbH” was registered.

This fuels speculation about a return.

After purchasing the trademark rights, Rossello told the industry portal

Aerotelegraph

that it had not yet been decided what the trademark should be used for: “There are some ideas.

Everything is possible,” he said.

However, he ruled out that he wanted to use it to replace the name of his specially founded airline Sundair.

“Sundair is now well established,” he explained.

The fact that, according to Aerotelegraph

, a new company with the name “Airberlin Luftverkehrsgesellschaft mbH” has now

been entered in the commercial register at the Charlottenburg district court is causing new speculation in the media about the airline's return.

According to the shareholder agreement, the company's task is to “operate an airline in commercial air traffic,” as the portal writes in the corresponding report.

New competition for Lufthansa soon?

It remains to be seen whether customers will soon be able to choose between Lufthansa and Air Berlin on the German market again.

Rossello only confirmed to

Aerotelegraph

that the company had been founded, but justified this by wanting to prevent the trademark protection from lapsing.

According to German trademark law, this happens if a trademark is not used commercially five years after registration.

Nothing will happen this year, “but who knows what it will look like next year?” said the Sundair boss.

With regard to the tasks, the partnership agreement continues to speak of the “purchase, sale and leasing of aircraft and other aircraft as well as products, items and services that are related to them”.

The company also wants to offer IT services for airlines and tour operators and conduct marketing in and on aircraft.

However, there are currently no employees, only one managing director, Rossello.
