A man from Tölzer has to answer for rape before the judiciary.

A 28-year-old from Bad Tölz has had to answer for rape in the Munich district court since Thursday.

But he vehemently denies the crime.

Bad Tölz/Munich – The defendant admitted that it was “rough sex” in the trial before the Munich Regional Court.

But his sex partner wanted it that way, he asserted, citing previous sex with the 21-year-old from Weilheim.

He denied the accusation of rape.

In a calm, clear voice and surprisingly soberly, the defendant described what had happened on the night of August 14th last year and in the time before.

His presentation at the hearing lasted a whole hour.

Occasionally he looked at the sheets of paper in front of him: he had obviously jotted down key points there so as not to forget anything.

He even described trivial things, such as a wine glass falling over, in detail.

Met young woman through social networks

He says he met the young woman three months earlier via social networks.

Soon after, she not only sent revealing pictures of herself, but also made it clear in “kinky texts” that she “likes harder sex” – just like he does.

A closer relationship was also out of the question because her father rejected him because of his foreign roots, the defendant reported in accent-free standard German.

Nevertheless, they met in June at the Tölzer reservoir.

And at the end of July in the same place again: She wanted to have a picnic and brought a blanket with her.

He had already looked in advance for a suitable meadow along the hiking trail there.

They “got along really well” and “everything went well”.

He even picked flowers for her.

When it was dark, they had sex on the meadow.

“Too soft,” she complained and added: “I thought you were more dominant.”

There are different accounts of what happened in the apartment

On the evening of August 13th they met in his room in his mother's apartment in Tölz, who was not at home.

They watched several episodes of a Netflix series and drank – “drank a lot,” as he emphasized.

In any case, the fact that the defendant was “not inconsiderably drunk” is also stated in the indictment.

But then the descriptions diverge: When the woman wanted to leave, the 28-year-old is said to have dragged her “back into the room and onto the bed there” and raped her there, according to the prosecution.

The defendant, on the other hand, states that he “grabbed her hand” when she wanted to leave: “But that was it.” Because he had to think about his father, who had died a year earlier, and started to cry, she went there voluntarily stayed in the apartment and comforted him.

The defendant apologizes for the bruises

The sex was no harder than the one on the meadow.

At that time, too, she offered “mild resistance” by “groaning a quiet stop.”

The defendant vehemently denies that she “said stop 16 times” in the apartment.

He only apologizes for the bruises: he probably “squeezed a little too hard.”

But he didn't have the impression that "anything happened against her will."

Also because they said “goodbye normally,” said the 28-year-old, who was released from custody two months after the alleged crime.

Incidentally, the 21-year-old could have left: during breaks or when he “nodded off in between”.
