The Dachau district court discontinued proceedings against a 20-year-old because of a fire.

A 20-year-old housewife has had to answer before the Dachau district court: she is said to have caused a fire in an apartment building in Indersdorf.

Dachau/Indersdorf – September 7th, 2023 was a bright late summer Thursday.

At around 5:30 p.m., the relaxing afternoon was over for around 60 fire departments from Indersdorf, Arnbach, Glonn, Niederroth, Virkirchen and the district fire inspection.

Reason: The balcony of an apartment on the second floor burned in an apartment building in Indersdorf.

The window panes and shutters on the first floor and ground floor were destroyed by the heat;

Flying sparks ignited the dry hedge in the garden.

Thankfully, no people were injured by the fire, but the material damage was enormous: a total of around 40,000 euros.

Because the fire investigators from the police “clearly” identified the balcony on the second floor as the source of the fire, there were countless cigarette butts on the balcony and the 20-year-old tenant of the apartment stated immediately after the fire that her Iqos e-cigarette was on the balcony table It was clear to the police: the young woman must have caused the fire!

She was tried yesterday in the district court on this charge of negligent arson.

20-year-old defends herself against the allegations

The 20-year-old, who claims to have recently found happiness and the right path through life during motherhood, vehemently defended herself against the accusation of negligence.

Her fiancé is the only real smoker in the household, and she smokes e-cigarettes after her daughter told her she stinks.

Her partner was at work that afternoon and she went shopping with her two-year-old child and her eight-year-old brother to an industrial area in Indersdorf around 5 p.m.

This trip, she initially explained to judge Cornelia Handl, was necessary because her little brother had suddenly become hungry.

“Otherwise he eats very, very little.

Almost nothing.” A few minutes later, the defendant, who now calls her 44-year-old mother her “best friend” after a “difficult” puberty, admitted: “I couldn't have smoked!” She had run out of tobacco sticks , “which was also a reason why I went shopping”!

But Judge Handl stopped the torrent of speech.

“But somehow it must have started burning!” Did the defendant perhaps turn on her Iqos device and then forget it on the balcony?

“Unimaginable,” claimed the accused.

And showed the judge and prosecutor how their e-cigarette works.

It doesn't glow, it just gets hot.

“I’ve never held a thing like this before,” admitted Handl.

What also happened to the defendant: The police officer who was on duty at the time had to admit that he had never entered the 20-year-old's apartment, let alone the balcony.

And the alleged admission that she had left her e-cigarette on the balcony only took place in the form of an “informational conversation”.

During the actual interrogation, the accused made use of her right to refuse to testify.

Police do not rule out a technical defect

The police also found little that was enlightening.

The fire was caused either by “improper handling of smoking devices” or – as the 20-year-old claimed – by a technical defect in the e-cigarette battery.

Since, according to Judge Handl, “it is not in favor of obtaining an expert opinion on the matter now,” she discontinued the proceedings against the woman from Indersdorf.

Handl was sure that “the whole story and the proceedings made enough of an impression” on the defendant.

She nodded.

With a relieved “Oof” she left the courtroom.
