Not much remained of the accusation that the public prosecutor's office made against two young men from Benediktbeuern and Bad Heilbrunn.

Now they stood before the Wolfratshausen district court.

The Benediktbeuren resident got away with a fine.

Bad Tölz-Wolfratshausen - The two craftsmen had to answer for theft in a particularly serious case before the Wolfratshausen district court.

According to the indictment, they are said to have stolen 500 kilograms of copper pipes and 100 kilograms of power cables worth a total of around 5,000 euros from the abandoned Moralt site in Bad Tölz.

Only the 26-year-old from Benediktbeur was convicted, but for stealing just 30 kilograms of brass valves.

The co-accused Heilbrunner (27) was acquitted.

Benediktbeurer confessed

After a short legal discussion between those involved in the proceedings at the beginning of the hearing, the Benediktbeur resident made a confession: On that Saturday at the beginning of July 2022, he and two friends drove to the area "with the intention of getting brass there," the accused explained.

“I thought it was going to be torn down.

I wasn't aware that it was a crime." The 26-year-old insisted that his friend and work colleague, who was sitting next to him in the dock, was not there.

DNA on the sports bag

The friend was targeted by investigators because his DNA was attached to a sports bag that was found at the crime scene filled with tools.

“It is denied that he has anything to do with the matter,” said his lawyer.

The two men often travel together, including privately, for sports and often in the company van.

That's why he often has his sports bag with him.

“There are countless ways his DNA could get on the bag,” said the defense attorney.

“We don’t know who the bag actually belongs to, nor how it got into the hall.” His client nodded in agreement, but did not comment further on the allegations.

Was observed by security

The amounts of copper and power cable stated in the indictment were based on the statements of a security employee who encountered the Benediktbeuern on his tour on July 9, 2022 at around 6 p.m.

The accused claimed that he was hired to repair water damage.

Shortly afterwards he drove off with two other men, whom the security guard could only vaguely describe.

The witness claimed that he then noticed in the halls “that many pipes were gone.”

Thanks to the photos he took of the van, the Benediktbeur resident, who was on open probation at the time of the crime, was quickly identified.

Benediktbeurer has to pay 3,600 euros

The 26-year-old was sentenced to a fine of 120 daily rates of 30 euros each, a total of 3,600 euros.

“He admits the theft of brass, and he will be convicted on this basis,” said Judge Helmut Berger in his verdict.

“We don’t have anything more.” That’s why the co-accused in Heilbrunner was acquitted as requested by the public prosecutor.
