The line of defense is cracked:
the court in Washington ruled today (Tuesday) that Trump does not have immunity for actions he did during his term as president.
This is a line of defense used by the former president, who claimed that he was granted protection for actions in the performance of his duties.
As mentioned, the judges of the Federal Court of Appeals in Washington rejected Trump's claims and determined that it is permissible to prosecute him for his part in disrupting the elections in 2020. "We cannot accept former President Trump's claim that the president has unlimited authority to commit crimes," the three judges wrote The court, "this is an authority that will neutralize the central brake on the executive arm: the recognition of the election results and their implementation."
The judges also added about the system of checks and balances: "Mr. Trump's approach would have resulted in the collapse of the separation of powers system in that the president would have been placed beyond the reach of all three branches. We cannot accept that the office of the president places all of her former subjects above the law forever."

Later, they referred to Trump's status change: "For the purposes of the criminal case - President Trump has become a Trump citizen, and he has the same protections as any other defendant."
Trump campaign spokesman Stephen Chung said the former president disagreed with the decision.
"If immunity is not granted to the president, any president who ends his term immediately will be prosecuted by the opposing party," he reasoned.
Trump is expected to appeal the decision to the Supreme Court - where conservative judges have a majority, with three of them appointed during his term as president.
If Trump appeals, the move could delay the start of hearings in the trial against the former president for sedition.
The trial is expected to open on March 4.
