This guarantee, provided for in article 744-6 of the Code of entry and stay of foreigners and the right to asylum, allowed these foreigners to be released.
Due to a lack of material proof from the prefecture, which nevertheless assured that it had carried out the necessary repairs, the prosecution did not appeal the decision.
