According to the chairman of the committee, MK Merav Ben Ari (Yesh Atid), the law is ready for the first reading, but there are religious disputes that must be discussed before the second and third reading discussions.

"The delay for approval in the first reading is only religious issues, and it is now awaiting the chief rabbi's decision and discretion," she explained.

"The pending issue is the requirement that the spouse approve the taking of the sperm - after the death. Such a requirement will worsen the current situation."

In the bill it is proposed to allow the spouse of a deceased person, who did not oppose it, to use his sperm after he passed away even if he did not leave behind explicit instructions on the matter, on the assumption that he wanted the continuity of the family unit he established and taking into account his spouse's right to parentage.



It is also proposed to allow the parent of the deceased, appointed by him in writing, to use his sperm through another woman who will be the mother of the child to be born, with the approval of the court, provided that the deceased did not have a partner, or the partner's daughter does not wish to use the sperm.

Within the framework of the law, it will be determined that the date of taking the sperm from the deceased will not precede the date of the determination of death and no sperm will be taken from the deceased if more than 48 hours have passed from the date of determination of cardio-respiratory death.

In addition, the director of the hospital's sperm bank will not approve the taking of sperm from a woman who has not yet turned 18 years old, unless he was a soldier.
