A bizarre trial took place at the Erding district court against a 51-year-old who enjoys and persistently taking on the authorities and neighbors.

Southern District/Erding

– In itself, it was everyday legal life without any explosiveness: A 51-year-old from the southern district was charged with assaulting law enforcement officers.

In May and June 2022, the police officer, who had been removed from duty after five years, clashed twice with neighbors and two police officers.

The next day he went on a rampage at the police station.

And yet the first day of the trial at the Erding District Court not only lasted five hours, it even had to be interrupted.

The enormous amount of time required was due to the fact that the defendant was extremely talkative, commented extensively on and denied the allegations and peppered the witnesses with questions.

However, presiding judge Thomas Bauer had to reject most of them as unjustified.

Not even his public defender, Georg Els, was able to stop him.

The defendant has an eventful and quite public biography.

He was involved in the DGB Erding and ran for the Left on the district council list.

He studied to be a teacher, worked in the security industry and as a chauffeur.

According to his own statements, he is now a recipient of citizen's benefit.

Prosecutor Magdalena Schmitt accused the 51-year-old of not only rudely pushing away a resident of his father's farm on May 18, 2022, but also filming him without authorization.

On June 18, 2022, he clashed with a neighbor whose own father (90) had asked to mow the lawn in the yard.

The defendant assumed that his dog had been put in danger.

The neighbor also mowed down three plastic food bowls.

A dispute developed, which the police ultimately tried to resolve.

The officers said that the 51-year-old was repeatedly disruptive and ultimately had to be taken into custody.

The defendant explained that at the end of the measure he was left outside the police station without a shirt or shoes, despite the outside temperature being over 30 degrees.

He then suffered sunburn and blisters on his feet.

Nevertheless, he made it back to the police the next day to file a complaint against the officers from the previous day.

According to the prosecution, in the security gate he became enraged, tore down posters and threw a writing pad in the direction of the officers.

The defendant contradicted this.

He wasn't taken seriously; he wanted to draw attention to himself.

The trial also focused on the man's culpability and whether he should be admitted to a psychiatric hospital again.

Dr.

Hubert Näger, doctor at the Landshut regional court, reported on the biography of the defendant, who had repeatedly received psychiatric treatment, including in connection with the accused acts.

A serious car accident involving the 51-year-old left consequences.

The district medical examiner described that the patient probably had a problem with police officers, not least because of his own (police officer) biography.

He reacts particularly sensitively to them.

Näger said that in the presence of his ex-colleagues there could have been a reduced ability to control things.

However, the man is not fundamentally incapable of guilt.

The trial continues on February 23rd.
