Singer Julia Neigel is suing against a Saxon Corona protection ordinance.

Bautzen - In the case of musician and singer Julia Neigel's Corona lawsuit against the Free State of Saxony, both sides exchanged their positions at an oral hearing on Thursday in the Higher Administrative Court (OVG) in Bautzen.

No decision was made on the admissibility of the regulatory review applications.

The Senate will first decide on an application for bias against the presiding judge and then discuss the question of whether the action is admissible.

A date for the announcement has not yet been set.

Neigel accuses the Free State of Saxony of introducing a 2G vaccination requirement for concerts after the pandemic Corona situation in Germany was lifted and of closing all cultural venues for months.

She spoke of an “arbitrary handling”.

You therefore incurred losses due to canceled concerts.

The artist had filed an application for regulatory review against the disputed Free State regulation from November 2021.

“At that point, the regulation was no longer in force,” explained an OVG spokesman.

The issue was whether it was still permissible to submit this application.

The Senate's decision determines whether the substance of the lawsuit will be negotiated.

Specifically, Neigel is concerned with the effectiveness of the regulations of the Saxon Corona Protection Ordinance of November 5, 2021 and the Saxon Corona Emergency Ordinance of November 19, 2021 in a later amended version.

She accuses the Free State of having introduced a 2G vaccination requirement for concerts that was “not intended at all” according to the Infection Protection Act after the pandemic situation in Germany was lifted and of having closed all cultural establishments for months despite the ban.

The cultural lockdowns ordered without specific hotspot regulations and a parliamentary resolution would generally have to be legally reviewed.

After the trial, the singer appeared to be in a good mood and combative.

“Cultural participation - mandatory international law - must not be suspended even in Corona times.

“I speak not only for myself, but also for my colleagues and for all citizens who want to experience culture,” she said.

As with the postponed date in summer 2023, fans and supporters of the artist came and the hall was filled to the last seat.

By order of the chairman, there were meticulous entry controls and a ban on cell phones in the hall.
