A man from the Schongau area now had to stand trial in court because he hit his girlfriend at the time with a broken bottle seven years ago.

A few years ago, the Schongau train station was the scene of a serious relationship dispute.

Among other things, the victim had to deal with a broken beer bottle.

Schongau - Accompanied by police and judicial officers, the accused, who was living in the Schongau area at the time of the crime, only moved slowly towards the dock.

Larger steps were thwarted by the ankle shackles.

However, the young man, who was brought before the Weilheim lay judges' court directly from custody, was not expected to attempt to escape - a confession was on the cards.

The indictment presented by the public prosecutor initially painted a threatening picture of the 29-year-old accused and described an extremely brutal and unscrupulous approach.

His appearance in court was completely different, where he left a guilty and purified impression.

The matter dates back over seven years.

According to the court, the defendant had gone into hiding, which is why he could not be brought to trial in a timely manner.

On a September evening in 2016, the then 21-year-old was at the Schongau train station with his girlfriend at the time at 9:30 p.m. when a verbal argument broke out between the two.

During the argument, he pushed his girlfriend against the station building and hit her in the face.

He then went one step further and used a broken beer bottle as the murder weapon.

Some time later, rescue workers arrived and the young man was temporarily restrained.

However, he quickly freed himself from the restraint and launched another violent attack on his girlfriend.

The outburst of anger caused his victim to suffer a short-term loss of consciousness as well as a laceration to his forehead and head.

Psychological consequences such as sleep disorders and depression were also present, it was said.

The defendant later even attacked one of the paramedics.

However, he was able to resist his attack and prevent anything worse from happening.

A subsequent alcohol test ultimately showed just under 1.7 per mille.

A legal interview was finally followed by a confession.

During his time in custody, he sought help on his own initiative to get his alcohol consumption under control.

Today he is aware of what alcohol abuse can lead to, which is why he has decided never to let it get to that point again.

Because of his confession, the court refrained from taking extensive evidence and did not examine a single witness.

In her closing speech, the public prosecutor once again referred to the paramedics, who “only wanted to intervene to help,” and noted that it was particularly traumatic for the victim to “be beaten by someone they trusted.”

Since he otherwise has a clean record from a criminal point of view and is now increasingly trying to get his life on track, she considered a suspended sentence, including a fine, to be justifiable.

Nevertheless, it is a “serious act”.

Although the incident happened a long time ago, his client confessed, the defense attorney praised the 29-year-old's behavior during the night and also called for a suspended sentence.

He apologized again and also thanked his current girlfriend, who had been a reliable support for him so far.

The jury's verdict was one year and three months probation.

Although he went into hiding immediately after the crime, “even after such a long time, people still get arrested,” the judge praised the rule of law.

“As you can see, the justice system doesn’t forget,” he added, pointing out what would have happened “if they had hit the jugular.”

Precisely because he is planning to start a family with his partner, the man must face his responsibilities and “not fall back into old patterns”.

As a precautionary measure, he should continue to take part in an anti-alcohol program.

The court refrained from imposing a fine.

“Stay clean,” appealed judge Lars Baumann and then ordered the 29-year-old’s release.
