After the brewery's bankruptcy, the next low blow for Maisach's beer culture comes: Bräustüberl owner Harry Faul is no longer allowed to hold open-air concerts in his Räuber-Kneißl beer garden.
Maisach – Reason: A resident who had moved here complained.
The woman only moved into the immediate neighborhood a few months ago.
The noise was obviously immediately a nuisance for them - and rightly so, as Mayor Hans Seidl confirms: "According to the development plan, outdoor music events are not permitted in this area." At the same time, the town hall boss regrets that "another piece of Bavarian cosiness is lost."
Legal loopholes
The community's hands are tied.
Seidl: “We have already pointed out the legal gap to the organizers a few times.” So far, they have simply been lucky according to the principle “Where there is no plaintiff, there is no judge” and the Bavarian motto “Live and let live”.
But now the law and paragraphs take effect.

The beer garden concerts have been held as part of the year-round Beer & Guitar evenings in the Bräustüberl for 16 years.
No one in the neighboring residential area had complained about it for 16 years.
Until August 25th last year.
Bavarian texts
The Bruck acoustic rock duo L&M (Lars Gillmaier and Markus Lechner) had just started singing the first songs with their typical Bavarian lyrics when a patrol from the Olching police station showed up in the beer garden around 7 p.m.
A resident complained about the loud music.
Gillmaier: “We had our sound system set up as normal as at any other concert.” L&M is considered a cult band in the regional music scene and is booked almost every weekend in the summer for beer garden concerts all over Upper Bavaria.
Change the development plan?
After the concert ban was posted on social media and it became known that the complainant was a recent “Zuagroaste”, a real shitstorm broke out in various Facebook groups.
Mayor Hans Seidl sees opportunities to change the development plan, but the landlord would have to pay in advance and commission a noise report - and also pay for it.
Cost: up to 8000 euros.

That's too much for Harry Faul "because of these few concerts a year".
He only wants to apply for an exemption from the municipal administration for Father's Day on May 9th.
