The announcement of a reform of land law in Mayotte illustrates the paroxysm of the migration crisis hitting this island.
The government faces the facts: the local situation no longer allows the application of common law.
This is the case with article 21-7 of the civil code.
The latter provides that any child born in France to foreign parents automatically acquires French nationality upon reaching the age of majority, under the dual condition of residing in France for at least five years since the age of 11.
This is what we call “soil law”.
However, Mayotte is experiencing, due to migratory flows, demographic growth beyond any control.
Its population (310,000 inhabitants in 2022) quadrupled between 1985 and 2020. Nearly half of this population is of foreign nationality.
Between a third and half of its foreign residents are in an irregular situation.
