Judge Helmut Berger sentenced a Wolfratshauser man to 14 months probation for distributing and possessing prohibited content.

Wolfratshausen – A recent decision by the federal government came too late for a man (42) from Wolfratshausen.

He was sentenced to 14 months in prison on probation by the Wolfratshausen district court for distributing and possessing child pornographic content - the minimum sentence was twelve months since a change in the law in the summer of 2021.

Last Wednesday, the cabinet decided to reduce this penalty again in certain cases.

Harsh punishment for picture and “fun video”: Wolfratshauser (42) sentenced to 14 months in prison

The origin of the case dates back a long time: at the beginning of December 2020, the Wolfratshauser presumably sent a picture of an unclothed 13-year-old girl from his apartment via “Kik Messenger”.

During a house search at the beginning of May 2022, additional suspicious files were found on the defendant's PC, including a video from the “fun video” category that made the rounds a few years ago and “is not fun at all,” as the judge made it clear to the defendant .

During the corona pandemic “lost in the internet” – father of a family convicted

During the corona pandemic, he was temporarily “lost in the internet,” the father of the family explained in court.

There he also “exchanged naked pictures of adult women” with other participants in porn forums for adults.

Until he received the fateful image file for which he now had to answer in court.

“I don’t know why I forwarded it,” said the 42-year-old.

“I can’t say what came over me.” The next day he left the messenger.

After the police visited him, he also underwent psychotherapeutic treatment, according to the defendant.

The therapist was unable to detect any pedophilic tendencies, as can be seen from a letter from the psychologist.

Judge Helmut Berger sentenced the Wolfratshauser, who has not previously been guilty of any criminal offense, to a prison sentence of one year and two months.

The judge determined that the probation period would be three years.

The convicted person must pay 1,000 euros to the German Child Protection Association

As a condition, the convicted person must pay 1,000 euros to the German Child Protection Association.

He also bears the costs of the procedure, “which are likely to be considerable,” as Berger emphasized.

“Paragraph 184b certainly needs to be reconsidered because it leaves the court no opportunity to react to the individual case,” the judge indicated in his judgment that he would have liked more leeway in this case.

This week the judge's wish was granted.

The initiative came from Federal Justice Minister Marco Buschmann.
