Highlights: Former deputy mayor of Paris in charge of housing tabled a bill against evictions. “More and more owners are using the recovery leave system to evict their tenant, put their accommodation on Airbnb and take huge amounts of money,” he said. According to legal texts, the owner can only opt for leave to take back his accommodation on the expiry date of the lease and only for three reasons: to sell the accommodation, to take it back (to live in it or to accommodate a close)

Paris senator Ian Brossat declared this Tuesday on franceinfo that he had tabled a bill against evictions of rental properties.

“We want to say stop this phenomenon.

» Former deputy mayor of Paris in charge of housing, Ian Brossat, now senator of the capital, has not forgotten the prerogatives that fell to him when he worked for Anne Hidalgo.

This Tuesday morning, the communist elected official of the Council of Paris announced on franceinfo that he had tabled a bill in favor of an Olympic truce in the face of rental evictions during the Games, and even beyond.

“More and more owners are using the recovery leave system to evict their tenant, put their accommodation on Airbnb and take huge amounts of money.

We are talking about tenants who will find themselves on the doorstep instead of tourists who will pay 500 to 1000 euros per night,” denounces the senator from Paris.

Preacious landlords want to take advantage of the Olympics to evict their tenants and rent their accommodation at high prices on Airbnb.

Unacceptable.

However, this practice is regulated by law.

According to legal texts, the owner can only opt for leave to take back his accommodation on the expiry date of the lease and only for three reasons: to sell the accommodation, to take it back (to live in it or to accommodate a close), or for a “legitimate and serious” reason (notably in the event of fault on the part of the tenant).

Possibility of being accompanied by a specialized lawyer

“Owners do not have the right to opt for takeover leave any way they want, but some are fraudulent and tenants find themselves impressed and do not dare to contest,” regrets Ian Brossat.

To remedy this lack of information, the Parisian elected official therefore recalled that the capital's town hall offered appointments to deal with these fraudulent expulsions: "There is the possibility for anyone who has had leave for recovery to contact a specialized lawyer to assist him in his efforts to find out whether the leave is fraudulent.

Because it is a phenomenon that we observe throughout Paris.

“I want a truce for the whole of 2024 which aims to restore confidence to tenants and to have a blank year without eviction of tenants.

The Olympic Games cannot be a great popular celebration if thousands of landlords evict their tenants to make money.

I am increasingly struck by elected officials who are confronted with it.

We can still vote on this bill,” insists the elected official, while recalling: “There are already 330,000 homeless people, let’s not add more.
