There is still trouble with garbage disposal in the Mühldorf district.

Despite the announced improvement, the yellow bags are not picked up regularly.

Mühldorf District - Contrary to the announcement by Reclay Systems GmbH on January 30th that the regular yellow bag collection process had been restored, the district continues to receive numerous complaints from citizens.

Many citizens in the district are not aware of any alleged improvement in the situation - including with the help of additional capacity at the responsible waste disposal company Dolgaimer GmbH.

Last week, a large number of yellow bags were again left behind on collection days - most recently on February 9th in Kraiburg, Polling and Mettenheim.

“The fact is that the bags provided in the district have not been completely collected on a single day this year in accordance with the respective announcement in the collection calendar.

Refills of entire communities or districts are no longer the exception, but the rule,” says the waste management team.

“In our opinion, it is foreseeable that the current collection practice, which involves a regular extension of the set 5-day week to 6 days, will have to collapse at the latest when the collection calendar extends to a Saturday as planned due to a public holiday.”

Against this background, District Administrator Max Heimerl sent a written warning to the client for the dual system to take all legal options to finally ensure proper disposal.

Ultimately, as the representative of the dual systems in Germany, Reclay must ensure, according to the Packaging Act, a comprehensive collection of all empty packaging in an adequate manner and free of charge for the end consumer.

“By purchasing the lightweight packaging, citizens have already paid for the disposal and are therefore entitled to the service owed being provided to their satisfaction,” says Heimerl.

Due to the removal performance of the company commissioned for the Mühldorf district, Reclay has only inadequately fulfilled its legal obligation in recent weeks: “Our patience has run out and Reclay has to deliver now.”

In the neighboring district of Landshut there was a voluntary exchange of waste disposal companies with the consent of the dual systems, but according to those involved, this is currently not possible in Mühldorf due to the contractual constellations.

At the same time, the district's options for action are limited because it has no contractual relationship with the waste disposal company.

The disposal of yellow bags is also not paid for through the district's waste collection fee.

Only the company Reclay, as the client of the dual system, can and must achieve an improvement here.

In order to vigorously represent the interests of the citizens, the district has long since pulled out all the stops.

Among other things, the waste management team meticulously documents all complaints and uncollected bags in order to inform Reclay on a daily basis about the waste disposal company's poor or non-performance.

In addition, District Administrator Max Heimerl has written to the Bavarian State Minister for the Environment and Consumer Protection, Thorsten Glauber, to act as the responsible supervisory authority: “We therefore ask that Reclay, as the client, act as quickly as possible to ensure that the lightweight packaging is disposed of legally .” Bundestag member Stephan Mayer was also asked to provide support and contact the Federal Environment Ministry.
