A patient from the Ebersberg district goes to court because of chronic dizziness after massive amounts of antibiotics.
He wants reparations.
District
- A couple from the southern Ebersberg district was really looking forward to their husband's retirement.
It should be beach and sea in Italy.
But then everything turned out differently.
The now 68-year-old suffered a life-threatening infectious heart valve infection.
He was given an antibiotic but still had to have surgery.
Because the risk was even greater after the heart valve replacement, he had to continue taking the antibiotic.
After two weeks, the dizziness almost knocked him down.
Attacks of dizziness and lightheadedness
He should never leave him again.
The patient went to court.
After five years, the case has finally been heard before the Munich I Regional Court.
In his opinion, the persistent dizziness and constant dizziness were caused by the antibiotic being given for far too long.
“I do my exercises in the gym regularly,” said the plaintiff.
That's the only reason he can now walk more or less properly again.
However, he suffered from an intense dizziness, “as if I had drunk five pints of beer,” he made a vivid comparison for the court.
Dizziness and dizziness still severely restrict his everyday life.
The 68-year-old can only ride his bike in a protected area - i.e. without car traffic.
In the dark and at dusk he must always be accompanied.
In his opinion and that of his neurologist, the intensive administration of the antibiotic had led to the subsequent damage.
Ebersberger demanded financial compensation in the five-figure range from the treating clinics.
The exact amount was not discussed.
However, the value of the lawsuit was 41,000 euros.
A matter of weighing up the administration of antibiotics
The attending doctors in the surgery clinic and in the rehabilitation clinic had little or no memory of the case.
A heart surgeon from the surgical clinic was of the opinion that it would certainly have been better to clarify the cause of the dizziness.
In general, however, he would have advised passing on the medication after weighing up the fatal risk and possible subsequent problems.
An expert confirmed this consideration and compared passing on the medication to cancer treatment, which is not avoided because of the risk of hair loss.
The problem with heart valve inflammation is the germ that cannot be easily identified or localized.
The appraiser has doubts
(By the way: Everything from the region is now also available in our regular Ebersberg newsletter.)

That's why the known effective antibiotic is given.
And: “Dizziness can have a hundred causes.” For example, it could also occur due to heart problems.
The expert therefore considered it justifiable that the antibiotic was continued - even if cases of deafness were already known.
He couldn't see anything wrong with his medical colleagues.
“I can’t give you much hope with this lawsuit,” the judge said to the 68-year-old.
After consulting with his lawyer, he withdrew the lawsuit.
“Terrible,” said his wife in the audience area.
“I could keep cursing for hours.”
