At its most recent meeting, the Miesbach city council spoke out in favor of an inclusion statute for Kreuzberg.

Not an easy undertaking - thanks to the train and swimming pool in the neighborhood.

Miesbach - Specifically, it is about a free-standing house that is located on an area between the district in the west and the railway embankment in the east.

On the other side of the tracks is the city's warm outdoor swimming pool - and that caused a lot of discussion in advance of the project.

As building authority manager Lutz Breitwieser explained to the council members, the small prefabricated house from 1949 is located in the inner area of ​​the city, but the area is considered to be outside due to the lack of classification.

Since the building is in poor condition, the only option left at this point would be a new building of the current size - and that would be too small for the family.

Problematic limits

Since the city wanted to help the family, the area was to be added to Kreuzberg through an inclusion statute.

The building committee recommended this approach in March 2023. However, problems arose in the subsequent process.

From the perspective of the district office, the reason for this was the outdoor swimming pool opposite and the adjacent railway tracks, which contradict the classification as a purely residential area.

Because neither the pool nor the train adhere to the applicable limit values.

But the city didn't let that stop them.

Because with a view to the Kreuzberg, 19 cases of commercial use can be proven there.

In individual cases this is not a problem, but overall this contradicts the classification as a purely residential area, explained Breitwieser.

Rather, it is a general residential area.

Informative noise report

In addition, a commissioned noise report showed that the limit values ​​for a purely residential area were exceeded there, but not those for a general residential area.

The planned pool operations were also taken into account.

A general residential area would therefore be conceivable.

However, the building applicants would have to make concessions by placing living and sleeping rooms on the side away from the sound and installing soundproof windows.

At the same time, they would have to enter into a commitment to tolerate the use of bathrooms, parking spaces and playgrounds.

The obligation to tolerate emissions is with the notary, and the district office would go along this route, Breitwieser reported.

The requirements for incorporating the property into the interior convinced the city council.

This unanimously decided to issue the “Am Kreuzberg” inclusion statutes.
