A routine operation during Oktoberfest had an unusual outcome for two police officers.

– The lack of understanding was clear to see in the two officials when they entered the meeting room.

According to the prosecution, they allegedly failed in their official duties and refused to help a man in need.

Shaking their heads, the two sat down in the dock.

He was called to Weilheim train station as support in September 2022, shortly before midnight, explained one of the two 34-year-old police officers.

Shortly after he had greeted his colleague in front of the station hall, he was approached by an drunken passer-by in traditional costume, a 29-year-old man from Biessenhofen.

“One secures, the other records the facts,” he explained their procedure - it was routine.

However, the mood became increasingly heated in the following minutes and almost degenerated into shouting.

The man didn't keep his distance

His colleague stated that he was “quite irritated” when he was approached by the passer-by.

You wouldn't normally ask him for help using words like "dude" and "digger."

The man then “jumped around in front of me like Rumpelstiltskin,” he reported.

“They want to hit me in the mouth,” he quoted the Oktoberfest visitor as saying.

However, it was not really clear who he meant.

“Who are they?” he asked him, but “didn’t get another sensible word” out of him.

The man also didn't keep his distance.

“I was worried that it would result in something physical,” said the police officer.

Maybe he really was threatened – “but I can’t work with him like that,” said the officer.

The man then absolutely wanted to use the police cell phone.

“Certainly not,” the police officer replied and instead offered to come with him to the station at the train station.

He could then have made a phone call there.

“Turned on stupidly, grabbed and waddled”

But he didn't even respond to the suggestion.

“I never sent him away,” the police officer asserted.

Some witness statements “cannot be surpassed in terms of absurdity”.

The man "didn't let himself be helped to die," he added, and stated that the ominous victim left soon afterwards - in order to "sort out" his problem himself.

Before he disappeared in the taxi, he borrowed a girl's cell phone.

The injured party reported that he had been “stupidly attacked, grabbed and waddled” on the train from Munich.

The opponents had announced that they wanted to kill him at the train station.

Surprisingly, his emergency situation left the officials cold.

“The police are there to help,” he said, irritated.

In his opinion - he admitted that he no longer remembered everything - the situation was calm.

When he turned away from the officers, whom he did not recognize in court, he asked a girl for her phone.

The strange incident was actually “over” for him the next day.

It was only through the 19-year-old and her friend, who had provided the 29-year-old with their cell phone, that criminal proceedings were ultimately initiated.

According to their own statement, the two had observed the situation as much as possible and were “horrified,” which is why they then asked the police officers why they did not want to help the man despite his pleas.

Ran away from unknown people to the police

Two other police officers, some of whom had joined later and had only peripherally witnessed the situation, largely supported the statements of their colleagues.

In detail, “a lot of inconsistencies” didn’t make it easy for those involved in the process.

The fact that even the public prosecutor ultimately demanded an acquittal was due to the lack of evidence of a threatening situation.

The injured party probably did not make it known enough that he wanted to file a criminal complaint.

The two defense attorneys agreed with his remarks.

“We can’t reconcile the statements,” one of the lawyers summarized it.

“You cannot convict with residual doubt,” said judge Isabelle von Heydebrand and at the same time found words of praise for the two young witnesses who, despite everything, left a convincing impression.

After a four-hour trial, the police officers' “personal nightmare” ended in an acquittal.
