Aschheim's mayor Glashauser has been out of office for 17 months.
Despite his absence, the administration appears to be running smoothly.
Aschheim
- The responsible municipal supervisory authority in the district office sees no impairment of the Aschheim municipal administration due to the absence of First Mayor Thomas Glashauser (CSU) for 17 months.
The authority announced this in response to Merkur's request.
As reported, Glashauser has been on sick leave for around 17 months due to burnout syndrome.
He is represented by the second mayor Robert Ertl (FW) and the third mayor Marion Seitz (Greens).
Ertl recently emphasized that he needs a decision from Glashauser by May this year as to whether he wants to return to office and, if necessary, bring new elections into play.
No complaints on site
The current structure in the town hall seems to be working quite well.
In any case, this is what the statements from the municipal supervisory authority suggest.
In the past year and a half, there have been no complaints from anyone regarding the conditions on site, says district office spokeswoman Franziska Herr.
There was also no situation in Aschheim “in which the local authority supervisory authority objected to decisions or orders and demanded that they be repealed or changed”.
The authority does not want to reveal whether the municipality of Aschheim turned to the municipal supervisory authority for assistance due to the mayoral vacancy.
“The supervisory authorities should provide the municipalities with compassionate advice, support and protection in the fulfillment of their tasks and should strengthen the determination and self-responsibility of the municipal bodies.
This task is regularly carried out by the municipal supervisory authority in all municipalities,” the district office says.
Substitution: No time limit provided
From a legal perspective, his deputy mayors could step in for Glashauser until the end of the electoral term.
In addition, the municipal council could appoint additional deputies from among its members in accordance with Article 39 paragraph 1 sentence 2 of the municipal code, the municipal supervisory authority reports.
“There is no legal limit on the time limit for representation work,” says Herr.
The local authority supervisory authority has no say in this matter.
Any procedural actions, be it the appointment of additional deputies, a new mayoral election or a retirement process, are solely the responsibility of the municipality in question, it is said.
New elections are necessary if the election period ends early.
However, there are no regulations regarding an end to the election period by law.
