Light on the horizon: Although there is new trouble with the former tunnel construction company BeMo from Tyrol, those responsible are still hoping for work to be resumed in Berg am Kramertunnel in April.

– When will construction of the Kramer Tunnel continue?

A question that concerns not only the citizens around Garmisch-Partenkirchen and beyond.

The implementation of far-reaching projects such as possible future relief for the Eibsee or a park center at Kreuzeck also depends on their answer.

But also a question to which there has hardly been an answer in the past six months.

But now there is light on the dark horizon: “I am quite confident that we can get started again in the spring,” says Stefan Scheckinger, head of the state building authority in Weilheim.

And not just outside, but hopefully also inside the Kramer.

But it is still too early to celebrate: the public procurement chamber of the government of Upper Bavaria has to decide on a complaint from BeMo Tunneling GmbH.

There was a breakup with that company from Tyrol last year, which meant that tunnel construction was stopped.

BeMo now applied again with new subcontractors, but was rejected by the state building authority.

A decision will probably be made in March.

Oral hearing before the Public Procurement Chamber on Tuesday

Scheckinger is relatively calm about the matter.

“I am in good spirits,” says the head of the department, whose authority is directing the construction of the Kramer Tunnel and the western bypass of Garmisch-Partenkirchen.

“But I don’t want to prejudge the chamber.” Of course, it is not the case that the building authority plunged into the new awarding of work unprepared.

There will be an oral hearing before the chamber in Munich next Tuesday.

Scheckinger doubts that a decision will be made immediately.

“But people there have already recognized that the whole thing is an urgent matter.

The case was dealt with really quickly.” The review process was initiated immediately after the complaint from the Tyrolean tunnel builders during the Christmas holidays.

The head of the authority expects a verdict in March at the latest.

This can of course be appealed again.

The case then ends up before the Higher Regional Court.

Nobody in Weilheim hopes that.

However, Scheckinger does not rule out that BeMo could go to extremes to simply delay the Kramertunnel project after the contract was canceled in spring 2023 due to high additional demands in the mid double-digit million range.

His motto: “Let’s hope for the best.”

Terminated company excluded from new procurement competition

Basically, the State Building Authority has been working hard on a solution.

The EU-wide procurement process was initiated last November.

The authority relied on a preliminary participation competition.

“You first ask who is interested in the construction service, see who comes forward and evaluate who is suitable for it,” he explains.

According to Raphael Zuber, the person responsible for major projects at the Weilheim building authority, “there were enough applications”.

Curiously, also that of BeMo, which, as is well known, was part of the old Kramertunnel working group.

“This company was excluded from the further procurement process because, in our opinion, it is not suitable,” explains Zuber.

Scheckinger goes into a little more detail: “It would have been absurd if we got involved in this venture again.” His office had no choice but to exclude the Tyroleans.

“Otherwise the whole game might have started all over again.” Those responsible in Innsbruck apparently saw it differently and lodged the complaint.

In the background, the award procedure continued in parallel with the complaint procedure.

“We took a bit of a risk, I admit that,” says Scheckinger.

But now the authority is simply concerned with the time factor.

Those responsible have divided the remaining work that is needed to complete the tunnel and bypass into three packages and put them out to tender.

Number one is the completion of the inner shell of the tunnel, number two is the installation of the roadway and sidewalks.

Package three consists of the entire outdoor area.

The latter in particular is scheduled to continue “full throttle” from mid-April.

The current plan is to start on April 15th at both portals.

“We want to largely complete the work on the north and south junctions in 2024,” emphasizes Zuber.

In plain language: The Loisach bridges in the south near Grainau and the groundwater basin including the connection from Burgrain in the north should be opened to traffic.

The building authority already has a new partner for the interior construction of the tunnel.

Scheckinger makes no secret of this.

But: “In order to conclude a contract, we need a positive decision from the chamber.”

Over the past few weeks, the construction site has looked like it's getting busy again and again.

However, that had nothing to do with the resumption of work.

Rather, it is currently a matter of BeMo completely clearing the construction site many months after the contract was terminated.

The authority has now set a deadline until the end of February so that nothing stands in the way of a new beginning.

“Overall, the handover is going really well,” says Scheckinger.

So: Another bright spot at the Kramer Tunnel.
